Kingsbury, Thomas Reiling - 8651 Barby <br />expressed concerns about the approval of the applications. Mike Peterson, 8655 W. Kingsbury spoke <br />in favor of the applications. <br />Conditional use Permit Amendment: The Plan Commission determined that the evidence presented <br />to the Plan Commission does support the conclusion that the proposed conditional use amendment: <br />a) Complies with all applicable provisions of the University City Zoning Code; b) At the specific <br />location will contribute to and promote the community welfare or convenience; c) Will not cause <br />substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, <br />neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with the <br />standards contained in Article 7 of the University City Zoning Code. Mr. Smith moved that the Plan <br />Commission recommend approval of the Conditional Use Permit Amendment with the following <br />conditions: <br />1.Except as heretofore modified or modified by the terms hereof, all conditions of conditional <br />use permits 241(A), 295, 295(A), 295(B), 295(C) and amendments thereto shall remain in <br />effect as to the property covered by said permits. <br />2.The approval of this application shall be contingent upon the full project area being rezoned to <br />be included in the “HRO” - High Density Residential/Office District. The height and mass <br />shall be restricted to that shown on the final approved conditional use application plans. The <br />elevation of the peak of the roof shall not exceed 586 feet. Said elevation shall be <br />demonstrated prior to issuance of a building permit. <br />3.The approval of this application shall be contingent on the rear (north) 50' of the lot located at <br />8655 West Kingsbury being resubdivided to be included in Lot 3 of the Gatesworth Addition <br />and a final plat being approved by City Council and filed with the County Recorder of Deeds <br />Office prior to issuance of a building permit. <br />The motion was seconded by Mr. Credit and passed by a vote of 5 to 0 with all members voting <br />“aye.” <br />Rezoning / Map Amendment: A motion was made by Mr. Smith, seconded by Mr. Irons and passed <br />by a vote of 5 to 0 that the Plan Commission recommend approval of the application for a map <br />amendment of the rear (north) fifty (50) feet of 8655 West Kingsbury from “SR” to “HRO.” <br />Resubdivision / Lot Consolidation: The Preliminary Plat for resubdivision of the properties known as <br />1 McKnight Place, 2 McKnight Place and the rear (north) fifty (50) feet of 8655 West Kingsbury was <br />approved at the meeting. The application consolidates the rear (north) fifty (50) feet of 8655 West <br />Kingsbury and 2 McKnight Place into one lot. Also, the applicants propose a total of three lots for <br />the entire development separated as follows: Lot 1 contains the Gatesworth Properties, Lot 2 contains <br />the existing nursing home at 2 McKnight Place and Lot 3 contains the proposed nursing home <br />K:\WPOFFICE\WPDATA\m-3-28.plc.wpd <br /> <br />
