November 28, 2001 Plan Commission Minutes Page 3 of 4 <br />The Plan Commission determined that the evidence presented to the Plan Commission does support <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will <br />provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code. Ms. Arbogast moved that the Plan Commission recommend <br />approval of the Conditional Use Permit with the following conditions: <br />1.Construction and development shall be in substantial conformance with the site plan, floor <br />plans and elevations submitted with this application. <br />2.A final detailed landscaping plan shall be submitted to the Director of Planning and <br />Development for review and approval after consultation with the City Forester. The plan shall <br />comply with the requirements set forth in Section 34-60.2 of the Zoning Code, including an <br />eight (8) foot high sight-proof fence along the rear property line and shall also provide <br />attractive plantings in the front of the property to improve the site’s appearance along Olive. <br />Any perimeter areas not specifically used for ingress and egress to the property shall be <br />improved to have landscaping areas added to the site. Said landscaping and site planning <br />design shall be maintained in accordance with the approved plan. Said plan shall be approved <br />prior to the issuance of the conditional use permit. Said plantings shall be installed and <br />finalized no later than May 31, 2002. <br />3.Overnight outdoor parking of motor vehicles shall be prohibited except for those vehicles <br />used in conjunction with the business. <br />4.With the exception of the storage of motor vehicles in accordance with Condition #3, all <br />business, service, storage and display shall be conducted within the building. <br />5.Service and repair operations shall be limited to the hours between 7:30 a.m. and 8 p.m. <br />6.All paving on the site shall be repaired or replaced to bring the surface into good repair. Any <br />perimeter areas not specifically used for ingress and egress to the property shall be improved <br />to have landscaping areas added to the site (per condition #2). <br />7.The operator of the convenience store/gasoline station shall regularly police the site and the <br />area adjacent to the store to remove litter and debris. <br />8. Trash containers for patron use shall be available on the premises at all times. Adequate <br />refuse disposal shall be provided by and for the business.
