December 12, 2001, Plan Commission Minutes Page 2 of 5 <br />st <br />Mr. Credit moved that the Plan Commission approve the preliminary plat for resubdivision at 1100 81 <br />Street. The motion was seconded by Mr. Smith and passed by a vote of 4 to 0 with all members <br />voting “aye.” <br />Public Hearing: Conditional Use Permit Amendment, Five Story Apartment Building - increase <br />in density, parking and change to elevations, 8300 Delmar <br />Chairperson Glassman announced that a public hearing was scheduled to hear an application from <br />Phoenix Property Company, c/o Tucker Lynch and Blair Pogue, 2626 Howell Street, Suite 800, <br />Dallas, TX 75204 represented by Jakob Medve,8251 Maryland, St. Louis, MO 63105. The applicant <br />requests an amendment tot he previously approved Conditional Use Permit in order to increase <br />density, parking and to make minor changes to the elevations at 8300 Delmar. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use permits <br />and amendments to them. The Chairperson specifically stated that the Plan Commission must consider <br />whether the use: a) Complies with all applicable provisions of the University City Zoning Code; b) At <br />the specific location will contribute to and promote the community welfare or convenience; c) Will not <br />cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive <br />Plan, neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with the <br />standards contained in Article 7 of the University City Zoning Code. <br />Mr. Medve stated that he is the current property owner and is representing the buyers at this hearing. <br />Mr. Medve gave an overview of the proposal and asked that the application be approved. He stated <br />that the applicants stated that they agree to the conditions set forth in the Staff Report. <br />Mr. Hill gave the staff recommendation that the application be approved per the December 6, 2001 <br />Staff Report. <br />The Chairperson asked for comments from the members of the Public. Tamadean Goldenhersch, 8316 <br />Delcrest stated that she was concerned about traffic congestion. Theodore Jacobs, 545 Westview <br />stated that he is concerned that the building will be too large in height. Vernon Fischer, #5 Delcrest <br />stated that he is concerned with off-street parking. He further wished to know why Mr. Medve was <br />representing the proposed owners. Mr. Medve responded that the building height and parking <br />requirements meet the requirements of the Zoning Code. No other members of the public wished to <br />speak and the Public Hearing was closed. <br />Ms. Arbogast stated that the applicant has not addressed the Staff concern about the reasons for <br />increase in density.
