December 12, 2001, Plan Commission Minutes Page 3 of 5 <br />The Plan Commission determined that the evidence presented to the Plan Commission does support <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will <br />provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code. Ms. Arbogast moved that the Plan Commission recommend <br />approval of the Conditional Use Permit with the following conditions (new or changed conditions are <br />in italics): <br />1.The building and property shall be developed, constructed and maintained in compliance with <br />the plans submitted with this application. <br />2.The permitted Floor Area Ratio (FAR) for this phase of the project shall be limited to 1.986. <br />Future projects on this block (the 8300 block of the south side of Delmar and the north side of <br />Delcrest) shall take into account this area when figuring FAR for the whole project. <br />3.A detailed landscaping plan shall be submitted to the Director of Planning for approval, in <br />conjunction with a review by the City Forester. Landscaping shall be installed and maintained <br />in accordance with the approved plan. Said landscaping plan shall be finalized prior to the first <br />residential occupancy permit being approved. <br />4.The height and mass is approved as shown on the drawings. <br />5.A detailed construction traffic control and parking plan should be submitted to the Director of <br />Planning for approval. Said plan shall set forth details pertaining to worker and resident <br />parking during all phases of the proposed construction. It shall further detail solutions to <br />public property maintenance issues such as street cleaning and traffic diversion. Said plan shall <br />be finalized prior to the issuance of a building permit. <br />6.Operation and use of the offered project amenities shall be for residents and their guests <br />only. <br />7.Lighting of all exterior areas, including the front parking area, shall comply with the <br />requirements of Section 34.93.7 of the Zoning Code, and shall be designed to be compatible <br />with surrounding areas by shading to direct light downward and away from abutting uses. <br />8.Drainage and grading arrangements shall be approved by MSD and the City Public Works <br />Department. <br />9.Exhaust control for common facilities shall be installed and maintained to prevent smoke and <br />odors from being perceptible beyond the property lines of the development. <br />K:\WPOFFICE\WPDATA\m-12-12-2001.plc.wpd <br /> <br />
