March 27, 2002, Plan Commission Minutes Page 2 of 3 <br />Mr. Dan Ryan, Sinclair Oil, 18 Oak Parks, St. Peters, MO 63376 spoke on behalf of the applicant and <br />have an overview of the proposal. He stated that the applicants agree to the conditions set forth in the <br />Staff Report. <br />Mr. Hill gave the staff recommendation that the application be approved per the March 21, 2002. <br />The Vice Chairperson asked for comments from the members of the Public. No members of the public <br />wished to speak and the Public Hearing was closed. <br />Mr. Smith stated that a condition should be added that requires any payphone to be located inside the <br />building to avoid loitering outside the store. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will <br />provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code. Mr. Smith moved that the Plan Commission recommend approval <br />of the Conditional Use Permit with the following conditions: <br />1.Construction and development shall be in substantial conformance with the site plan and floor <br />plans submitted with this application. A revised site plan shall be submitted showing the <br />elimination of parking spaces 3, 4, 14 and 15. <br />2.A detailed landscaping plan shall be submitted to the Director of Planning for review and <br />approval, after consultation with the City Forester. The landscape material shall be installed <br />and shall be maintained in accordance with the plan. Said plan shall be submitted and approved <br />prior to the operation being approved for an occupancy permit. <br />3.There shall be no outdoor overnight parking on the premises. <br />4.Hours of operation shall be limited to the hours between 6 a.m. and 10 p.m. <br />5.All paving on the site shall be repaired or replaced to bring the surface into good repair. The <br />parking lot shall be striped to conform with the site plan. <br />6.All operations and sales shall take place inside the building. There shall be no outdoor display <br />of merchandise (including but not limited to soda, wood, automotive supplies and other such <br />items). <br />7.All payphones on the premises shall be located inside the building.
