March 27, 2002, Plan Commission Minutes Page 2 of 3 Mr. Dan Ryan, Sinclair Oil, 18 Oak Parks, St. Peters, MO 63376 spoke on behalf of the applicant and have an overview of the proposal. He stated that the applicants agree to the conditions set forth in the Staff Report. Mr. Hill gave the staff recommendation that the application be approved per the March 21, 2002. The Vice Chairperson asked for comments from the members of the Public. No members of the public wished to speak and the Public Hearing was closed. Mr. Smith stated that a condition should be added that requires any payphone to be located inside the building to avoid loitering outside the store. The Plan Commission determined that the evidence presented to the Plan Commission does support the conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of the University City Zoning Code; b) At the specific location will contribute to and promote the community welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any other official planning and development policies of the City; and e) Will provide off-street parking and loading areas in accordance with the standards contained in Article 7 of the University City Zoning Code. Mr. Smith moved that the Plan Commission recommend approval of the Conditional Use Permit with the following conditions: 1.Construction and development shall be in substantial conformance with the site plan and floor plans submitted with this application. A revised site plan shall be submitted showing the elimination of parking spaces 3, 4, 14 and 15. 2.A detailed landscaping plan shall be submitted to the Director of Planning for review and approval, after consultation with the City Forester. The landscape material shall be installed and shall be maintained in accordance with the plan. Said plan shall be submitted and approved prior to the operation being approved for an occupancy permit. 3.There shall be no outdoor overnight parking on the premises. 4.Hours of operation shall be limited to the hours between 6 a.m. and 10 p.m. 5.All paving on the site shall be repaired or replaced to bring the surface into good repair. The parking lot shall be striped to conform with the site plan. 6.All operations and sales shall take place inside the building. There shall be no outdoor display of merchandise (including but not limited to soda, wood, automotive supplies and other such items). 7.All payphones on the premises shall be located inside the building. No exterior payphones shall be permitted. The motion was seconded by Mr. Irons and passed by a vote of 5 to 0 with all members voting “aye.” Mr. Price was not present for this agenda item).
