June 26, 2002, Plan Commission Minutes Page 3 of 6 <br />shall show how the tables will not affect the free flow of pedestrian traffic in the area to <br />be used for dining. <br />3.The operator of the restaurant shall regularly police the site and the area adjacent to the <br />restaurant to remove litter and debris. <br />4.Trash containers for patron use shall be available on the premises at all times. Adequate refuse <br />disposal shall be provided by and for the business. The refuse containers and surroundings <br />shall be maintained in a clean condition. <br />5.The building and all signing shall be in strict compliance with the sign requirements of the <br />zoning code. <br />6.Parking for patrons at the 7401 Pershing / 400 Jackson building shall be permitted at the 7400 <br />Pershing lot during the hours the businesses there are not opened, per the March 8, 2001 letter <br />submitted by NHS Properties (incorporate herein by reference). <br />The motion was seconded by Ms. Borg and passed by a vote of 4 to 0 with all members voting “aye.” <br />Public Hearing: Conditional Use Permit, Auto Repair Facility, 8130 Delmar <br />Chairperson Credit announced that a public hearing was scheduled to hear an application from <br />Shamrock Automotive #1, LLC dba Meineke Muffler represented by Roger McCabe, 1759 Horseshoe <br />Ridge Road, Chestefield, MO 63005 requesting to open an automotive repair facility at 8130 Delmar. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use permits <br />and amendments to them. The Chairperson specifically stated that the Plan Commission must consider <br />whether the use: a) Complies with all applicable provisions of the University City Zoning Code; b) At <br />the specific location will contribute to and promote the community welfare or convenience; c) Will not <br />cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive <br />Plan, neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with the <br />standards contained in Article 7 of the University City Zoning Code. <br />Mr, Roger McCabe spoke on behalf of the applicant and gave an overview of the proposal. He stated <br />that the applicants agree to the conditions set forth in the Staff Report. <br />Mr. Hill gave the staff recommendation that the application be approved per the June 20, 2002 Staff <br />Report. <br />The Chairperson asked for comments from the members of the Public.
