September 25, 2002, Plan Commission Minutes Page 3 of 3 <br />case shall any minimum front yard setback be less than twenty-five <br />(25) feet. <br />34-30.5 Density and Dimensional Regulations <br />3. Building Height Limitations: Except as provided for in Article 5, "Supplementary <br />Regulations," Section 34-54 (height exceptions), no principal building shall exceed <br />three and one-half (3-1/2) stories or thirty-five (35) feet in height, whichever is less. <br />However, if a new structure exceeds the height (as defined in Article 2) of the <br />principal structure on abutting property by more than 15 feet, than the side yard <br />setback along the side in question shall be increased to 8 feet. <br />Ralph Bowser, 8050 Teasdale, Tom Engelhardt, 7830 Lafon, and Joan Botwinick, 511 Westview <br />spoke in favor of increasing setbacks and height limits. <br />Mr. Self moved that the proposed text amendments be approved, the motion was seconded by Ms. <br />Borg and passed by a vote of 3 to 1, with Ms. Arbogast, Mr. Self and Ms. Borg Kreishman voting aye <br />and Mr. Smith voting nay. Mr. Smith stated that he voted against the proposal because it had not <br />been determined what affect the new regulations would have on development. <br />Adjournment <br />Mr. Self moved for adjournment.
