October 23, 2002 Plan Commission Minutes Page 2 of 4 <br />the specific location will contribute to and promote the community welfare or convenience; c) Will not <br />cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive <br />Plan, neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with the <br />standards contained in Article 7 of the University City Zoning Code. <br />Mr. Zwolak spoke on behalf of the applicant and gave an overview of the proposal and asked that it be <br />approved. <br />Mr. Hill gave the staff recommendation that the application be approved per the November 7, 2002 <br />memo. <br />The Chairperson asked for comments from the members of the Public. Carol Mitchell, 848 Kingsland <br />stated that she is the director of the Kings Day care located at 848 Kingsland and that she opposes the <br />new use because it will put her out of business. No other members of the public wished to speak and <br />the Public Hearing was closed. <br />A motion to postpone the vote until the December meeting was made by Ms. Arbogast, seconded by <br />Mr. Irons and failed by a vote of 2 to 2, with Ms. Arbogast and Mr. Irons voting “aye” and Mr. Smith <br />and Mr. Myers voting “nay.” A motion was made to approve the use with Staff recommended <br />conditions by Mr. Smith, seconded by Mr. Myers and failed by a vote of 2 to 2, with Mr. Smith and <br />Mr. Myers voting “aye” and Ms. Arbogast and Mr. Irons voting “nay.” <br />The Plan Commission asked the applicant to do a market feasibility study of the area for daycare uses <br />and to return to the December Meeting. <br />Public Hearing: Conditional Use Permit Amendment, Extend Pharmacy Drive-through Hours, <br />7501 Olive <br />Chairperson Arbogast announced that a public hearing was scheduled to hear an application from <br />Walgreens represented by Pace-Olive LLC, 1401 S. Brentwood Blvd., Suite 100, St. Louis, Missouri <br />63144. The applicant requests that the drive-through pharmacy hours be increased to 24 hours per <br />day at 7501 Olive. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use permits <br />and amendments to them. The Chairperson specifically stated that the Plan Commission must consider <br />whether the use: a) Complies with all applicable provisions of the University City Zoning Code; b) At <br />the specific location will contribute to and promote the community welfare or convenience; c) Will not <br />cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive <br />Plan, neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with the <br />standards contained in Article 7 of the University City Zoning Code. <br />K:\WPOFFICE\WPDATA\m-11-13-2002.final.plc.wpd <br /> <br />
