April 23, 2003 Plan Commission Minutes Page 5 of 6 The Chairperson asked for comments from the members of the Public. No members of the public wished to speak and the Public Hearing was closed. The Plan Commission determined that the evidence presented to the Plan Commission does support the conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of the University City Zoning Code; b) At the specific location will contribute to and promote the community welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any other official planning and development policies of the City; and e) Will provide off-street parking and loading areas in accordance with the standards contained in Article 7 of the University City Zoning Code. Mr. Smith moved that the Plan Commission recommend approval of the Conditional Use Permit with the following conditions: 1.A final detailed landscaping plan shall be submitted to the Director of Planning for review and approval after consultation with the City Forester. Approval of the landscaping plan shall be contingent upon it being considered to demonstrate that there is special landscape design and site planning features per Section 34-36.5(4) of the Zoning Code. Said landscaping and site planning design shall be maintained in accordance with the approved plan. Said plan shall be approved prior to the issuance of a building permit. 2.Site coverage shall be increased to 79%. 3.Drainage and grading arrangements shall be approved by MSD and the City Public Works Department. 4.A detailed construction traffic control and parking plan should be submitted to the Director of Planning and Director of Public Works for approval. Said plan shall set forth details pertaining to worker and resident parking during all phases of the proposed construction. It shall further detail solutions to public property maintenance issues such as street cleaning and traffic diversion. No construction workers shall park on the public streets during the construction period. Said plan shall be approved prior to the issuance of a building permit. 5.Requirements for irrigation shall comply with Section 34-60.6 of the Zoning Code. Plans for irrigation shall be finalized prior to issuance of the building permit. 6.The height and mass shall be restricted to that shown on the final approved conditional use application plans.
