April 23, 2003 Plan Commission Minutes Page 5 of 6 <br />The Chairperson asked for comments from the members of the Public. No members of the public <br />wished to speak and the Public Hearing was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support the <br />conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of <br />the University City Zoning Code; b) At the specific location will contribute to and promote the <br />community welfare or convenience; c) Will not cause substantial injury to the value of neighboring <br />property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if applicable), <br />and any other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the University City <br />Zoning Code. Mr. Smith moved that the Plan Commission recommend approval of the Conditional Use <br />Permit with the following conditions: <br />1.A final detailed landscaping plan shall be submitted to the Director of Planning for review and <br />approval after consultation with the City Forester. Approval of the landscaping plan shall be <br />contingent upon it being considered to demonstrate that there is special landscape design and site <br />planning features per Section 34-36.5(4) of the Zoning Code. Said landscaping and site planning <br />design shall be maintained in accordance with the approved plan. Said plan shall be approved <br />prior to the issuance of a building permit. <br />2.Site coverage shall be increased to 79%. <br />3.Drainage and grading arrangements shall be approved by MSD and the City Public Works <br />Department. <br />4.A detailed construction traffic control and parking plan should be submitted to the Director of <br />Planning and Director of Public Works for approval. Said plan shall set forth details pertaining <br />to worker and resident parking during all phases of the proposed construction. It shall further <br />detail solutions to public property maintenance issues such as street cleaning and traffic <br />diversion. No construction workers shall park on the public streets during the construction <br />period. Said plan shall be approved prior to the issuance of a building permit. <br />5.Requirements for irrigation shall comply with Section 34-60.6 of the Zoning Code. Plans for <br />irrigation shall be finalized prior to issuance of the building permit. <br />6.The height and mass shall be restricted to that shown on the final approved conditional use <br />application plans. <br />The motion was seconded by Mr. Irons and passed by a vote of 4 to 0 with all members voting “aye.” <br />Adjournment <br />K:\WPOFFICE\WPDATA\m-5-28-2003.plc.wpd <br /> <br />
