Richard Bowser of 8015 Teasdale <br />stated that he is concerned with overflow parking. No members of the public wished to speak and the Public <br />Hearing was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support the <br />conclusion that the proposed conditional use amendment: a) Complies with all applicable provisions of the <br />University City Zoning Code; b) At the specific location will contribute to and promote the community <br />welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any other <br />official planning and development policies of the City; and e) Will provide off-street parking and loading <br />areas in accordance with the standards contained in Article 7 of the University City Zoning Code. Mr. Smith <br />moved that the Plan Commission recommend approval of the Conditional Use Permit with the following <br />conditions: <br />1.A final detailed landscaping plan shall be submitted to the Director of Planning and Development for <br />review and approval after consultation with the City Forester. The plan shall comply with the <br />requirements set forth in Section 34-60.2 of the Zoning Code. Said landscaping and site planning <br />design shall be maintained in accordance with the approved plan. Said plan shall be approved prior to <br />the issuance of the building permit. Said plantings shall be installed and finalized no later following <br />planting season after occupancy. <br />2.Outdoor sales, display and storage shall be limited to items involving gardening and planting materials <br />only. Said outdoor sales, display and storage shall be maintained in an organized and professional <br />looking manner. The exterior storage shall not block ingress and egress to the property and shall not <br />hinder the use of any parking spaces as set forth in the submitted site plan. With the exception of the <br />above, all business, service, storage and display shall be conducted within the building. <br />3.All paving on the site shall be repaired or replaced to bring the surface into good repair. <br />4.The operator of the facility shall regularly police the site and the area adjacent to the store to remove <br />litter and debris. <br />5. Trash containers for patron use shall be available on the premises at all times. Adequate refuse <br />disposal shall be provided by and for the business. The refuse containers and surroundings shall be <br />maintained in a clean condition. <br />6. Lighting of all exterior areas, including all parking areas, shall comply with the requirements of <br />Section 34.93.7 of the Zoning Code, and shall be designed to be compatible with surrounding areas, <br />shall be shaded to direct light downward and away from abutting uses with particular attention to the <br />screening of light away from the residential uses to the south. <br />7.An six foot high sight-proof fence or wall shall be either be established or maintained along all areas <br />adjacent to residentially zoned property per Section 34-60.2(1) of the Zoning Code. <br />The motion was seconded by Mr. Irons and passed by a vote of 6 to 0 with all members voting “aye.” <br />K:\WPOFFICE\WPDATA\m-11-12-2003.final.plc.wpd <br /> <br />
