January 28, 2004 Plan Commission Minutes Page 4 of 5 <br />Ms. Arbogast moved for approval. The motion was second by Mr. Kreishman and passed by a vote of 4 to 2 <br />with 4 voting “aye” and 2 voting “nay”. <br />Public Hearing: Conditional Use Permit, Vehicle Repair Facility, 8314 Olive <br />The Chairperson announced that the continuation of public hearing from December 10, 2003 was scheduled <br />to hear an application from Brian Le and Tommy Le from 8314 Olive. The applicant requests that they be <br />permitted to operate a vehicle repair facility (a vehicle accessory parts retail location with installation of car <br />stereo, detailing and automotive repair). <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use permits and <br />amendments to them. The Chairperson specifically stated that the Plan Commission must consider whether <br />the use: a) Complies with all applicable provisions of the University City Zoning Code; b) At the specific <br />location will contribute to and promote the community welfare or convenience; c) Will not cause substantial <br />injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood <br />development plan (if applicable), and any other official planning and development policies of the City; and e) <br />Will provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code. <br />Alvah Levine, Levine Associates, 8630 Delmar Blvd., represented the applicants and gave an overview of the <br />proposal and asked that it be approved. <br />Mr. Hill gave the staff recommendation that the application be approved per the Staff Report. <br />The Chairperson asked for comments from the members of the Public. Tony Quartuccio of 8301 & 8318 <br />Olive stated there were police problems at the property at 8314 Olive the day after the December 10, 2003 <br />meeting and that they have been installing for 1.5 years. <br />Ms. Ricci questioned what services are offered by Light Speed Performance. Mr. Le of 8314 Olive <br />responded that they do detailing, body work, chrome, rims, and fenders. In addition, engine modification and <br />upgrade performance import cars. If test driving in the neighborhood they would get ticket for that. They <br />don’t have any speeding tickets. <br />Ms. Ricci questioned does Light Speed test drive cars in the neighborhood. Mr. Le responded that they have <br />asked customers to not test drive cars. <br />Ms. Ricci questioned are the upgraded engines louder or more powerful. Mr. Le responded that they last <br />longer and improve performance. They do not encourage drag racing and that they do not build race cars. <br />Mr. Sharpe requested a report to Council from the Police. <br />Ms. Ricci question is Light Speed dressing up of engines?
