December 22, 2004 Plan Commission Minutes Page 3 of 5 <br />Hearing: Resubdivision, 501 Jackson <br /> <br /> <br />The Chairperson Pro Tem announced that a hearing was scheduled concerning an application from <br />Miracle Design/Build, Inc. c/o Mrs. Jane Kaplan, 501 N. Jackson, University City, MO 63130 to <br />subdivide the lot at 501 Jackson into two lots. <br /> <br />The Chairperson Pro Tem noted the Commission's procedures and criteria for reviewing resubdivision <br />applications. Eric Schmidt, Attorney, 168 N. Meramec, #400, Clayton, MO 63105, represented the <br />applicant and gave an overview of the application and asked that it be approved. Mr. Hill gave the <br />staff recommendation that the application be approved per the Staff Report. <br /> <br />The Chairperson Pro Tem asked for comments from members of the public. Sandra Lovus, 7425 <br />Teasdale; Karen LiPuma, 539 Jackson; Brigitta Toth, 7416 Washington; and Dan and Stella Wolf, <br />7398 Bedford all spoke against the proposal. James Holtzman, 1207 Dubois Ct., St. Louis, MO <br />63122 stated that buildings they propose will be masonry. Richard Essman 1039 Corporate Square <br />Drive, St. Louis, MO 63132, the real estate developer spoke in favor of the proposal. No other <br />members of the public wished to speak and the hearing was closed. <br /> <br />Mr. Smith moved that the Plan Commission recommend approval of the resubdivision. The motion <br />was seconded by Mr. Marentette and passed by a vote of 3 to 1 with Mr. Smith, Mr. Marentette and <br />Ms. Ricci voting “aye” and Ms. Borg voting “nay.” <br /> <br />Public Hearing: Conditional Use Permit, Restaurant, 6662 Delmar <br /> <br /> <br />The Chairperson Pro Tem announced that the public hearing was scheduled to hear an application <br />from Linhardt Inc. dba Cold Stone Creamery, 1624 Kingsford Drive, Florissant, MO 63031. The <br />applicant requests that they be permitted to operate an ice cream restaurant on the ground floor along <br />Delmar in the “CC” - Core Commercial District at 6662 Delmar, Unit B. <br /> <br />The Chairperson Pro Tem noted the Commission's procedures and criteria for reviewing conditional <br />use permits and amendments to them. The Chairperson Pro Tem specifically stated that the Plan <br />Commission must consider whether the use: a) Complies with all applicable provisions of the <br />University City Zoning Code; b) At the specific location will contribute to and promote the <br />community welfare or convenience; c) Will not cause substantial injury to the value of neighboring <br />property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if <br />applicable), and any other official planning and development policies of the City; and e) Will provide <br />off-street parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br /> <br />Ron Powell, 2023 Graystone Dr., St. Charles, MO 63303, represented the applicant and gave an <br />overview of the proposal and asked that it be approved. <br /> <br />Mr. Hill gave the staff recommendation that the application be approved per the Staff Report. <br /> <br />m-12-22-2004 plc final (2).doc <br /> <br />
