December 22, 2004 Plan Commission Minutes Page 2 of 5 <br />Mr. Marentette moved that the Plan Commission recommend approval of the map amendment. The <br />motion was seconded by Mr. Smith and passed by a vote of 4 to 0 with all members voting “aye.” <br /> <br />Mr. Marentette moved that the Plan Commission should recommend approval of the preliminary <br />development plan and that the council pass the following resolution: <br /> <br />RESOLUTION <br /> <br /> WHEREAS, Section 34.40.14.2 of the University City Zoning Code requires that the <br />preliminary development plan be approved by the city council by adoption of a resolution approving <br />said preliminary development plan, with conditions as may be specified and authorizing the <br />preparation of the final development plan. Section 34.40.05 of the Zoning Code requires that the <br />permitted land uses and developments shall be established in the conditions of the ordinance adopted <br />by the city council governing the particular planned development-residential district. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />UNIVERSITY CITY, MO AS FOLLOWS: <br /> <br />The City Council hereby authorizes the preparation of the final development plan for <br />the proposal for this map amendment and resolution, to be known as “Kingsland Walk <br />Condominiums.” The specific use of “Dwellings, elevator apartment” is designated as <br />the permitted use, and said use shall be developed with the following conditions: <br /> <br />1. Minimum lot size shall be reduced to below 2 acres as proposed in the application. <br />2. The building and property shall be developed, constructed and maintained in compliance with <br />the plans submitted with the approved application. The height and mass shall be restricted to <br />that shown on the application plans. <br />3. A detailed landscaping plan shall be submitted to the Director of Planning for approval, in <br />conjunction with a review by the City Forester. Landscaping shall be installed and maintained <br />in accordance with the approved plan. Said landscaping plan shall be finalized prior to the <br />first residential occupancy permit being approved. <br />4. Lighting of all exterior areas shall comply with the requirements of Section 34-93.7 of the <br />Zoning Code, and shall be designed to be compatible with surrounding areas by shading to <br />direct light downward and away from abutting uses. <br />5. Drainage and grading arrangements shall be approved by MSD and the City Public Works <br />Department. <br />6. A detailed construction traffic control and parking plan should be submitted to the Director of <br />Planning for approval. Said plan shall set forth details pertaining to worker and resident <br />parking during all phases of the proposed construction. It shall further detail solutions to <br />public property maintenance issues such as street cleaning and traffic diversion.
