Within HR and HRO districts, sites shall be located only on buildings fifty (50) feet <br />or more in height with telecommunications antennas mounted on wall or roof surfaces <br />without the use of towers. <br /> <br /> d. Where feasible and aesthetically acceptable, the location of a telecommunications <br />facility shall be located on City-owned or controlled property or right-of-way, with the <br />exception of right-of-way within or abutting a residential district or school or park site. <br /> <br /> 7. Maintenance <br />. <br /> <br /> All facilities shall be maintained and improved to remain in the condition in which they <br />were approved. <br /> <br /> a. Inspection: Periodic: Once every year, and immediately after any major modification <br />of an existing facility, the City shall retain, at the operator’s expense, an approved engineer <br /> <br />to conduct an unannounced inspectionof the facility’s compliance with the applicable FCC <br />radio frequency and power emission standards. A report of this inspection shall be given to <br />the Zoning Administrator and City Manager. <br /> <br /> b. Inspection and Repair: After a damaging event. The operator shall authorize an <br />inspection of the structural integrity of the tower or disguised support structure and the <br />antenna itself following a tornado within five miles of the city limits; or following an <br />earthquake in the greater St. Louis metropolitan area with a magnitude of 5.5 or greater <br />on the Richter scale; or following other events covered by the repair bond, per Subsection <br />2j above, within thirty days of such events. In the event that structural damage is found, <br />the operator shall repair such damage within an additional thirty days of such events. The <br />applicant’s surety bond shall cover the expense of repairing of the damage per Subsection <br />2j for the city if repairs are not arranged by the applicant within the time limit. <br />Certification of the inspection and repairs, if any, shall be sent in a report to the City <br />Manager within an additional thirty days. <br /> <br /> <br /> <br /> 8 Certification of Facilities. <br />a. No wireless communications facility or combination of facilities shall at any time <br />produce power densities that exceed the Federal Communications Commission’s <br />limits for radiofrequency strength and power density for transmitters. In order to <br />ensure continuing compliance with all applicable emission standards, an approved <br />engineer shall review the schedule and procedures of the wireless <br />communications facility. <br />(1) Within forty-five (45) days of initial operation or modification of a <br />telecommunications facility, the owner or operator of such facility shall <br />submit to the Zoning Administrator a written report by a City-approved <br />engineer that the facility’s radiofrequency radiation levels are in compliance <br />with the approved application and any federal or state regulations.
