October 19, 2005 Plan Commission Minutes Page 2 of 16 <br />2. General Development Requirements <br />l. Insurance. The applicant shall submit a statement that he/she will procure adequate <br />insurance, as determined by the Plan Commission and approved by City Council, to cover <br />liability, bodily injury, and property damage. The insurance shall cover, but not be limited <br />to, the site, and to the facility and its operation. Proof of such insurance must be submitted <br />to and approved by the Zoning Administrator after the application for a conditional use <br />The City of University City <br />permit has been approved, but before the permit is issued. <br />shall be named as an additional insured. <br />The following will be added at the very end as subsection 10 <br />10. Exercise of Rights <br />No failure on the part of the City to exercise and no delay in exercising any right that <br />it has hereunder shall preclude any other or further exercise thereof or the exercise <br />of any other right of University City. <br />Mr. Smith stated that he still wished for a proper blackline version of the ordinance and that there should <br />be a full review by the City Attorney prior to approving the text amendment. He added that he agreed with <br />Ms. Ricci’s proposed additions to the text amendment. <br />Ms. Ricci stated that a caveat should be added that the Commission is not charged with nor were they <br />looking at compliance with Federal law in this approval. <br />Ms. Borg amended her motion to include the additions and the caveat proposed by Ms. Ricci, as follows: <br />The Plan Commission is not charged with nor were they looking at compliance with Federal law in this <br />approval. <br />34-64.4 Wireless telecommunications towers, antennas, <br />support structures, and buildings or enclosures for the <br />power and operating equipment of such facilities <br />Purpose and Intent. <br /> <br /> The purpose and intent of this section of the Zoning Code are to: <br /> <br /> a. Enact appropriate regulations, in accordance with the U. S. Telecommunications Act <br />of 1996, for the provision of personal wireless service facilities in University City, <br />Missouri; <br /> <br /> b. Establish standards to regulate the placement and design of wireless communications <br />facilities so as to preserve the well-being of the community; to assure compatibility with <br />properties adjacent to such facilities; to minimize adverse effects, including discordant visual <br />K:\WPOFFICE\WPDATA\m-10-19-2005.plc.final.wpd <br /> <br />
