No other <br />members of the public wished to speak and the Public Hearing was closed. <br /> <br />Mr. Blackwell was asked about a grant in lieu of payment of taxes on the property. He responded that <br />whatever arrangement that Webster University has with the University City would continue. It was <br />determined that the expiration date for the permit did not need to be extended until May 1, 2007 and <br />should be changed to March 1, 2007. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission does support the <br />conclusion that the proposed conditional use or amendment thereto: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will provide <br />off-street parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. Mr. Kreishman moved that the Plan Commission recommend approval <br />of the Conditional Use Permit with the following conditions: <br /> <br />1. The conditional use permit shall not expire until March 1, 2007. <br /> <br />The motion was seconded by Ms. Ricci and passed by a vote of 5 to 0 with all members voting "aye." <br /> <br />Text Amendment: Municipal Code Section 12.08 - Tree and Shrub Ordinance <br /> <br />The Vice Chairperson announced that the hearing was scheduled to hear an application from the City <br />for an amendment to Municipal Code Section 12.08 - The Tree and Shrub Ordinance. The Vice <br />Chairperson noted the Commission's procedures and criteria for reviewing text amendments. <br /> <br />Mr. Meyers clarified the creation of the Urban Forestry Commission. It was suggested by Ms. Ricci <br />that a paragraph be added, similar to that added to the telecommunications ordinance that states, "No <br />failure on the part of the City to exercise and no delay in exercising any right that it has hereunder shall <br />preclude any other or further exercise thereof or the exercise of any other right of University City." <br />She also asked that a paragraph be added that makes University City be an additional insured. <br /> <br />Vote on the proposal was tabled until James Crowe, City Forester could come before the Commission <br />and further explain the operation of the ordinance. <br /> <br />Text Amendment: Zoning Code Section 34-104.2 Political Signs <br /> <br />The Vice Chairperson announced that the hearing was scheduled to hear an application from the City <br />for an amendment to Zoning Code Section 34-104.2 concerning political signs.
