Except as heretofore modified or modified by the terms hereof, all conditions of conditional use <br />permits 241 (A), 295, 295(A), 295(B), 295(C), 295(D) and amendments thereto shall remain in effect <br />as to the property covered by said permits. <br /> <br />2. Except as noted below, the property shall be developed, constructed and maintained in compliance <br />with the plans submitted with the approved application. <br /> <br />3. The use of construction parking shall be limited to one year from the date of approval of the <br />conditional use permit amendment and any extension of that time must be approved by City Council <br />upon written request by the applicant. <br /> <br />4. The approval of this application shall be contingent upon the properties at 8660 and 8666 Barby Lane <br />not being rezoned to be included in the "HRO" - High Density Residential/Office District. <br /> <br />5. A site-proof fence shall be installed along the west property line of 8666 Barby Lane (to the east of <br />the proposed pine tree screen on berm in the same area) and across the front building line across <br />8660 and 8666 Barby Lane. Said fence shall be constructed and installed prior to the use of the <br />properties as a parking lot. It shall be the applicant's responsibility to obtain approval for the fence <br />and install in a timely manner prior to use of the parking lot. <br /> <br />6. Parking on the lot shall be limited to day time use of the construction workers for the rehab project <br />and shall not be used for storage of any kind. Parking on the lot shall be limited to the hours between <br />6:45 am and 8:00 pm Monday through Saturday. <br /> <br />7. A final detailed landscaping plan shall be submitted to the Director of Planning for review and <br />approval after consultation with the City Forester. Landscaping shall comply with the requirements set <br />forth in condition #5. Said landscaping shall be maintained in accordance with the approved plan. <br />Said plan shall be approved prior to the issuance of a building permit for the parking lot. It shall be <br />the applicant's responsibility to obtain those approvals in written form in a timely manner prior to <br />issuance of the building permit. Said landscaping plan shall include a pine tree screen on berm along <br />the west property line of 8666 Barby Lane to the east of the fence located along that property line. <br />Said landscaping shall be installed at the earliest time possible in the spring but no later than April 30, <br />2006. <br /> <br />8.
