<br />February 22, 2006 Plan Commission Minutes <br /> <br />Page 3 of6 <br /> <br />Public Hearing: Conditional Use Permit, Drive-Through ATM, 7434 Olive <br /> <br />The Vice Chairperson announced that the public hearing was scheduled to hear an application from <br />Vance Pena of Security Vault Works, Inc., 12935 Gravois Rd., Suite G, St. Louis, MO 63127. The <br />applicant requests that they be permitted to erect a drive-through ATM at 7434 Olive (in the parking lot <br />of Pete's Shur Sav grocery store). <br /> <br />The Vice Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Vice Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City Zoning <br />Code; b) At the specific location will contribute to and promote the community welfare or convenience; <br />c) Will not cause substantial injury to the value of neighboring property; d) Is consistent with the <br />Comprehensive Plan, neighborhood development plan (if applicable), and any other official planning and <br />development policies of the City; and e) Will provide off-street parking and loading areas in accordance <br />with the standards contained in Article 7 of the University City Zoning Code. <br /> <br />The applicant gave an overview of the proposal and asked that it be approved. Mr. Hill gave the staff <br />recommendation that the application be approved per the Staff Report. The Vice Chairperson asked for <br />comments from the members of the Public. No members of the public wished to speak. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission does support the <br />conclusion that the proposed conditional use or amendment thereto: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if <br />applicable), and any other official planning and development policies of the City; and e) Will provide off- <br />street parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. Ms. Ricci moved that the Plan Commission recommend approval of the <br />Conditional Use Permit with the following conditions: <br /> <br />1. A final detailed landscaping plan shall be submitted to the Director of Planning and Development <br />for approval, in conjunction with a review by the City Forester. Landscaping shall be installed <br />and maintained in accordance with the approved plan. Said landscaping plan shall be finalized <br />prior to issuance of the building permit and shall be installed in a timely manner within the next <br />available planting period from the date of approval of the plan. It shall be the applicant's <br />responsibility to obtain those approvals in written form in a timely manner prior to issuance of <br />the building permit. <br /> <br />2. Plans for improving the quality and condition of the existing parking lot at Pete's Shur Sav, <br />including restriping, repaving and/or resealing shall be submitted by the applicant. Said plan <br />shall be in conjunction with the building permit for the ATM and island. Said parking lot plan <br />shall be finalized prior to issuance of the building permit.
