<br />March 22, 2006 Plan Commission Minutes <br /> <br />Page 20f5 <br /> <br />Hearing: Resubdivision - Condominium, 6501 - 25 Delmar (odd) and 601 - 615 Westgate (odd) <br /> <br />The Vice Chairperson announced that a hearing was scheduled concerning an application from DCC <br />Enterprises, LLC represented by Caroline P. Saunders, Husch & Eppenberger, LLC, 190 Carondelet <br />Plaza, Ste. 600, St. Louis, MO 63105 for final plat approval to subdivide four buildings into 45 <br />residential and 4 commercial condominium units. <br /> <br />The Vice Chairperson noted the Commission's procedures and criteria for reviewing subdivision plats. <br />The applicant was represented by the owner, Rick Yackey, 6336 Westminster, University City, MO <br />63130. Mr. Yackey gave an overview of the proposal and asked that it be approved. Mr. Hill gave the <br />staff recommendation that the application be approved per the Staff Report, noting that two additional <br />items need to be added to the plat: 1) Area in square feet for the full lot shown on the plat and 2) the <br />Zoning district classification (in this case "CC" - Core Commercial District). Mr. Hill also stated that <br />each unit's address shall be labeled separately and correctly on the plat. Mr. Hill recommended that the <br />additions and changes shall be put on the plat before proceeding to City Council. The Vice Chairperson <br />asked for comments from the members of the public. No members of the public wished to speak. <br /> <br />Mr. Kreishman moved that the Plan Commission recommend approval of the final plat with Staff's <br />proposed additions and changes. The motion was seconded by Mr. Smith and passed by a vote of 6 to <br />o with all members voting "aye." <br /> <br />Public Hearing: Conditional Use Permit Amendment, New Grocery with increased site coverage, <br />7701 Olive and 1227 North & South <br /> <br />The Vice Chairperson announced that the public hearing was scheduled to hear an application from <br />Gary Berutti ofBerutti & Associates (representing Aldi Inc.), 204 West Main Street, Belleville, IL <br />62220. The applicant requests that they be permitted to construct a one story brick masonry <br />commercial building (Aldi Store) with an increase in site coverage. This application amends the <br />previously approved conditional use permit by incorporating the property at 1227 North & South into <br />the plans. <br /> <br />The Vice Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Vice Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City Zoning <br />Code; b) At the specific location will contribute to and promote the community welfare or convenience; <br />c) Will not cause substantial injury to the value of neighboring property; d) Is consistent with the <br />Comprehensive Plan, neighborhood development plan (if applicable), and any other official planning and <br />development policies of the City; and e) Will provide off-street parking and loading areas in accordance <br />with the standards contained in Article 7 of the University City Zoning Code. <br /> <br />The applicant gave an overview of the proposal and asked that it be approved. Mr. Hill gave the staff <br />recommendation that the application be approved per the Staff Report. The Vice Chairperson asked for <br />comments from the members of the public.
