<br />March 22, 2006 Plan Commission Minutes <br /> <br />Page 3 of5 <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission does support the <br />conclusion that the proposed conditional use or amendment thereto: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan (if <br />applicable), and any other official planning and development policies of the City; and e) Will provide off- <br />street parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. Ms. Ricci moved that the Plan Commission recommend approval of the <br />Conditional Use Permit with the following conditions: <br /> <br />1. Drainage and grading arrangements shall be approved by MSD and the City Public Works <br />Department prior to issuance of a building permit by the Department of Planning and <br />Development. It shall be the applicant's responsibility to obtain those approvals in written form <br />in a timely manner prior to issuance of the building permit. <br /> <br />2. Ingress and egress shall be as proposed on the plans submitted for this application. <br /> <br />3. The width of the landscaped strip along North & South is reduced from 10 feet to 8.5 feet due <br />to the requirements of turning lanes set forth by the St. Louis County Highway and Traffic <br />Department. Their site coverage is increased from the required 70% limit to 81 % due to the <br />increased area required by the County. <br /> <br />4. A final detailed landscaping plan shall be submitted to the Director of Planning for review and <br />approval after consultation with the City Forester. Said landscaping shall involve moving the <br />proposed fence along the north property line closer to the north building wall and installing a <br />row of tall hedges along the north property line to buffer the proximity to the residence to the <br />north. Said landscaping and site planning design shall be maintained in accordance with the <br />approved plan. Said plan shall be approved prior to the issuance of a building permit. <br />Requirements for irrigation shall comply with Section 34-60.6 of the Zoning Code. Plans for <br />irrigation shall be finalized prior to issuance of the building permit. It shall be the applicant's <br />responsibility to obtain those approvals in written form in a timely manner prior to issuance of <br />the building permit. <br /> <br />5. Trash containers for patron use shall be available on the premises at all times. Adequate refuse <br />disposal shall be provided by and for the business. The refuse containers and surroundings shall <br />be maintained in a clean condition. Trash receptacle containers should be screened per Section <br />34-60.4 of the Zoning Code. There shall be no trash removal scheduled between the hours of8 <br />p.m. and 8 a.m. The business shall be responsible for the monitoring the premises and the <br />surrounding properties for trash and shall participate in removing trash from the surrounding <br />area. <br /> <br />6. A detailed construction traffic control and parking plan shall be submitted to the Director of <br />Planning and Development and the Director of Public Works for approval.
