Session 1755 <br />May 10, 1999 <br /> <br />Ms. Colquitt agrees with Mr. Lieberman. <br /> <br />Mr. Schoomer does not see an adult market evolving here. There is no adjacent rapid <br />transit, no pedestrian destination or traffic pattern here. He does not understand where the <br />operator expects his adult clientele to come from, since the adults in the area are opposed. <br /> <br />Ms. Colquitt said that remembering the convenience store from many years ago, she did <br />not remember there being a problem with the high school students coming to the store or <br />loitering. It was a nice neighborhood just to go and pick up some odds and ends and that <br />was it. <br /> <br />The Mayor called ¢or the question to deny. Ayes: Mr. Wagner and Mr. Sharpe, the rest of <br />Council voted Nay. <br /> <br />Ms. Colquitt moved to approve the conditional use permit with the stated conditions. Mr. <br />Munkel seconded the motion. <br /> <br />Mr. Ollendorff asked if a condition should be added to restrict the sale of cigarettes. The <br />sense of Council was not to add it. <br /> <br />The motion carrie¢ with Mr. Wagner voting Nay. <br /> <br />Mr. Schoomer adv,sed the applicant to look at his marketing plan, get some expert advice, <br />get a good business plan before he goes through with this business. He fears that it is not <br />a sound plan and he might wish to rethink it before he ultimately commits to it. <br /> <br />AGENDA #5 - PUBLIC HEARING DATE FOR 500-546 NORTH & SOUTH REZONING: <br /> <br />The next step in ccnsidering the rezoning of property at 500-546 (eastside) North & South <br />Rd. from Single-Fa'nily and Planned Development to High Density Residential is to set a <br />public hearing date. Mr. Ollendorff recommends that such action be delayed since the City <br />Council's policy ha:; been to give favorable consideration to rezoning only in conjunction <br />with an acceptable development plan. While the general concept is one that has been <br />endorsed and enco,Jraged by the City Council and City staff, the conditional use plan is not <br />acceptable in its present form. The applicant should have some confidence that when a <br />less massive building proposal is prepared the project will receive favorable consideration <br />starting with the setting of a rezoning public hearing date. <br /> <br />Mr. Schoomer said that the developer has expressed a willingness to modify his plan and <br />believes he should oe given that opportunity.
