The parents <br />should be held responsible. <br /> <br />Responding to Mr. Sharpe, Mr. Haney said that the five major items would be coffee, milk, <br />bread, cheese, and hand dipped ice cream. <br /> <br />Responding to Mr. Munkel, Mr. Haney said that he had no problems with the conditions. <br />Responding further to Mr. Munkel, Mr. Haney said that he was planning to sell cigarettes. <br /> <br />Ms. Colquitt asked Mr. Ollendorff if it was possible to add a condition that a child could not <br />be served, in the mornings, unless they are with an adult. Mr. Haney believes that this <br />limits his ability to run a successful business. Mr. Ollendorff replied that this could not be <br />enforced. It woul(I be difficult to make it work legally. <br /> <br />Mr. Ollendorff wis~led to clarify his response to Mr. Lieberman earlier. The only mention of <br />this area in the comprehensive plan states that it is well suited for retail to be converted to <br />office uses, but there is no mention of discouraging new retail from coming in. <br /> <br />Mr. Schoomer asked Mr. Ollendorff to clarify the requirements for parking for commercial <br />use. Mr. Ollendorff said that, in this instance, it is based on floor space. He is required to <br />have five parking spaces. There are that many on the street adjacent to the store, but there <br />are none on the property. It therefore meets the requirements. Mr. Schoomer stated that he <br />thought these spa(:es were also dedicated to the apartments near there. Mr. Ollendorff said <br />that he was correct and that these spaces are used by more than this retail space. <br />Discussion at the Plan Commission level had the hours restricted to closing at 6 p.m., so <br />that retail customers are gone, before the apartments dwellers come home from work. <br /> <br />Mr. Sharp asked Mr. Wagner what the neighbors opposition was to this store being opened <br />in their neighborhood. Mr. Wagner stated that they did not want the store to become a <br />loitering ground for kids after school is let out. Mr. Wagner also feels that the parking is <br />inadequate and will cause traffic problems. <br /> <br />Mr. Wagner moved denial of this conditional use permit. Mr. Sharpe seconded the motion. <br /> <br />Mr. Lieberman asked Mr. OIlendorff if this building had been unoccupied for a long time. <br />Mr. OIlendorff said that he was not sure and would look into it. Mr. Schoomer believes it <br />has been vacant a '.~vhile and that the last owner also ran a convenience store. Mr. <br />Schoomer said that there had been several operators in this location which have failed. Mr. <br />Lieberman said that considering the limited use and the area of this building, he feels that <br />this could be an as:Get.
