Session 1755 <br />May 10, 1999 <br /> <br />AGENDA #4 - CONDITIONAL USE - 900 PURDUE: <br /> <br />The Plan Commission recommends denial of a conditional use permit to operate a small <br />convenience shop at this location. The Plan Commission heard written and verbal <br />comments from many neighbors who were opposed to this use of the property. I <br />recommend that lhe use be approved if the following conditions are agreed to by the owner: <br /> <br />2. <br />3. <br />4. <br />5. <br />6. <br />7. <br />8. <br /> <br />Store mus! operate between the hours of 7:00 a.m. and 6:00 p.m., <br />There will ~e no alcoholic beverage sales. <br />There will r~e adequate trash and refuse containers and disposal. <br />There will ~e daily litter removal from the adjacent area. <br />There will r~)e no outside sales or furniture. <br />There will t)e no entertainment facilities or devices. <br />Sales will be limited to prepackaged food and household items plus coffee to go. <br />All signs must conform to City ordinances. <br /> <br />It must be noted tlat even with such conditions the Plan Commission and the neighbors <br />oppose this use of the property. <br /> <br />Mr. Lieberman asked how this property is identified in the comprehensive plan. Mr. <br />Ollendorff said that small quiet commercial is identified on both corners here, nothing <br />bigger. <br /> <br />Mr. Munkel said ttlat he saw this property over the weekend and it is very small. He has <br />doubts that this can be a viable business. <br /> <br />Mr. Wagner reported that at the Plan Commission the primary concern of the neighbors <br />was that this wouIJ attract kids and become an after school gathering place. <br /> <br />Mr. Schoomer said that retail use requires more parking and there is no dedicated parking, <br />yet he cannot see any other business that could go in there. He is not sure how to resolve <br />this question and would like to hear more from Council. <br /> <br />Mr. Sharpe said that being a former school principal, the concept of having a neighborhood <br />joint for children tc come to and pick up candy, or whatever prior to school is definitely not <br />good. Bringing the stuff to school is not conducive for a good learning environment. <br />Consequently, he i.'; opposed to this concept. <br /> <br />Mr. Terry Haney, 7936 Cornell, said that he appreciated Mr. Sharpe's comments, but his <br />emphasis is on coffee for residents on the way to work, not junk for kids on the way to <br /> <br />8 <br /> <br /> <br />
