Session 1705, Minutes <br />September 8, 1997 <br /> <br />hard to imagine these types of luxury apartments going for anything less that two spaces in <br />off the street parking per two bedroom unit. Many of these folks may have more than two <br />cars. He believes the two car requirement is necessary. <br /> <br />Mr. Schoomer said that he did not agree with the code in a great many of places. In fact, <br />the same argument that Fir. Wagner presented about street parking was presented about <br />the church property and rejected by him. What we must do, is abide by the law that we <br />have. it is in our power to change it, but under the Constitution, we cannot pass an expos <br />facto. <br /> <br />Mr. Wagner moved to deny the site plan. Fir. Munkel seconded. <br /> <br />Mayor Adams wished to make a clarification to what Fir. Wagner said about the curb cuts <br />on the street. Mr. Ollendorff said that the developer would develop the changes, not the <br />City. <br /> <br />Fir. Lieberman asked if the curb cut approach could be imposed by the City, at any time. <br />Mayor Adams answered in the affirmative. Fir. Ollendorff said it would be a street <br />improvement by special tax bill which could be done now or ten years from now. Mr. <br />Lieberman asked if it would cut into sidewalk and greenspace. Fir. Ollendorff said the <br />Council could make any public improvement within the right-of-way, which means <br />rearranging the street, the curb, the sidewalk adjacent to this property, grass, pavement, <br />trees, parking signs and then contract the work and bill the owner. <br /> <br />Mayor Adams ordered a roll call vote on this question: AYES: Fir. Munkel, Mr. Wagner, <br />Mr. Lieberman. NAYS: Mr. Ware, Fir. Schoomer, Mayor Adams. The motion failed due <br />to a tie vote. <br /> <br />Mr. Schoomer moved to approve with conditions as proposed. Fir. Ware seconded the <br />motion. AYES: Mr. Ware, Fir. Schoomer, Hayor Adams. NAYS: Fir. Hunkel, Hr. <br />Wagner, Hr. Lieberman. The motion failed due to a tie vote. <br /> <br />Mr. Schoomer moved to table the motion, pending a study of the elevations and fill. Fir. <br />Ware seconded. All voted Aye, except Fir. Wagner who voted Nay. The motion to table <br />carried 5 to 1. Mayor Adams said that Fir. Wagner is requesting that the motion to <br />remove from the table would not come up at the next Council meeting, but the following <br />one on October 1 3th. Mayor Adams, therefore, would not look for a motion to take it <br />off the table at the next Council meeting. <br /> <br /> <br />
