Session 1705, Minutes <br />September 8, 1997 <br /> <br />permit for the plaza at the i~!arket in the Loop. The plaza is sitting on City street rift-of- <br />way, which Hr. 011endorff proposes to vacate. The comprehensive plan says that there <br />should be no street or driving across that property. Council asked that some conditions be <br />prepared prior to vacation to make sure that the property is not used improperly. The <br />conditions are as follows: <br /> <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />6. <br /> <br />10. <br /> <br />11. <br /> <br />The hours of public use shall be limited to those after 7 am and before 11 <br />pm. <br />Carry-out restaurants shall be permitted within the existing structures without <br />the need for separate conditional use approvals. <br />Operaton of restaurants shall regularly police the common areas of the <br />premises to remove litter and debris. <br />A sufficient number of trash containers for patron use shall be provided on <br />the premises and shall be regularly emptied and maintained. <br />Adequate refuse disposal shall be provided for the businesses on the <br />premises. <br />The premises include the enclosed market buildings, the open market <br />building with it's vehicular service areas and pedestrian areas, and the public <br />plaza located between the building at 6631 Delmar and the building at <br />6655 Delmar. <br />The public plaza shall not be used for parking of any manner. <br />No buildings shall be constructed on any part of the public plaza. <br />The improvements in the public plaza including planten, lighting and <br />concrete work shall be maintained and kept in good repair; and no changes <br />or additions shall be made to such improvements without the prior approval <br />of the City Council. <br />Portable outdoor furniture shall be removed from the public plaza and <br />suitably stored during the. months of January and February. No storage of <br />outdoor furniture or other items shall be permitted in the public plaza. <br />All activities shall be in strict compliance with the municipal noise ordinance. <br /> <br />Mr. Schoomer moved approval of the conditional use amendment. Mr. Munkel seconded <br />the motion. <br /> <br />Mr. Schoomer asked Mr. Oliendorff if this had also been heard by the Plan Commission. <br />Mr. Ollendofff said that it had. <br /> <br />Mr. Lieberman said that the only comments that were heard by the public at the Plan <br />Commission meeting dealt with noise and thus the addition of condition number eleven. <br />The all aye motion carried unanimously. <br /> <br /> <br />
