Session 1705, Minutes 7
September 8, 1997

attempt at one time to kind of limit that, but not the last franchisee. They could take a
look at this and possibly narrow down a few Items from individual sale. Mr. Lieberman said
that the purpose of this is to prevent the buyers from sitting outside and consuming the
beer. Ms. Wilson said that this activity was a violation of state liquor laws and that the
store tries to keep an eye on it to make sure that it is not happening. Mr. Lieherman said
that by restricting or limiting the variety of individual liquor sales would help them in their
efforts of eliminating this type of activity. Ms. Wilson agreed.

Mr. Ware moved approval of the liquor license transfer. Mr. Munkel seconded the
motion, which carried unanimously.

AGENDA ITEM #6 - CONDOMINIUH RESUBDIVISION: 7379 PI:.RSHING:

Mr. Ollendorff recommends approval of a resubdivision into four condominiums of the
building at 7379 Pershing. The Plan Commission recommends approval and finds that it
meets all of the requirements of the various City ordinances.

Mr. Schoomer asked if the taxes were paid. Mr. Ollendorff responded in the affirmative.

Mr. Schoomer moved approval of the resubdivislon. Mr. Munkel seconded the motion,
which carried unanimously.

AGENDA NO. #7 - SITE PLAN - 6951 OLIVE AT BARTHER:

Mr. Ollendorff said that the Council is asked to review a site plan for 695 ! Olive at
Bartmet. A revised site plan was submitted a couple of hours ago. Approval is
recommended but only with several conditions. There should be only one driveway and
that it be the westernmost driveway. The revised plan does meet the City's parking
requirements. Trash dumpsters, mechanical equipment, and exterior lighting must be
screened and/or shielded from the view of adjacent residential areas and Olive Street Rd.
The electric and other utility meters must be on the north side of the building. The off site
improvements must include full concrete paving of the adjacent alley which is now
unpaved. The broken and substandard Olive and Bartmet sidewalks must be replaced.
The landscape plan is not adequate as submitted. An effort should be made to save a
couple of large trees on the south and west side of the property. The City Manager
stressed that the building design should include some brick. The proposed building is a
metal building and should meet the City's sign ordinances. it can not include the amount
of decorative painting and other features that are shown on the various models. it would
greatly exceed the ordinance.
