Session 1120, Minutes <br />December 15, 1975 <br />Page 14 <br />the same vacation basis: if the vacation period for the basic 40 hour em- <br />ployee goes up or changes, the same ratio would be adjusted for the fire- <br />fighters and others working more than a 40 hour week. <br />Mr. Douglas Nord, a member of the University City Fire Department, spoke in <br />opposition to the proposed change, and felt that the recommendation of the <br />Civil Service Board should be supported by the Council. <br />Upon vote, the motion made earlier by Councilman Lieberman and seconded by <br />Councilman Glickert, was unanimously adopted. <br />Councilman Lieberman said that under the Civil Service Rule X, paragraph 5, <br />which is titled "Sick Leave", he does not recommend any changes in the <br />first two paragraphs, but he recommends two additional paragraphs to be in- <br />serted, as follows: <br />"Effective January 1, 1976, all references to the previous stated <br />rate of sick leave accrual are for regular employees working five <br />days per week on an approximate 40 hour per week schedule. Sick <br />leave shall be computed on a proportionate basis for regular em- <br />ployees whose average work week is more or less than 40 hours. <br />In an effort to further equalize the sick leave benefits amongst <br />all full time city employees, Firefighters, Fire Captains and <br />Ambulance Drivers who work a schedule fewer than 5 days per <br />calendar week and have as of December 31, 1975 sick leave days <br />accumulated shall have said number of days reduced and posted <br />to their sick leave accumulation account on January 1, 1976 in <br />an amount equal to 7/15 of their December 31, 1975 totals. Maxi- <br />mum accumulation of unused sick leave after January 1, 1976 for <br />Firefighters, Fire Captains, and Ambulance Drivers may not total <br />more than 42 working days." <br />Councilman Lieberman moved adoption of the change of the Sick Leave portion <br />of the Civil Service Pules, as set out above. Motion was seconded by Coun- <br />cilman Adams. <br />City Manager Ellman explained'that this pertains to the Sick Leave benefit <br />program which will be treated on a formula similar to the Annual Leave <br />benefit. The 7/15 represents the fraction which one derives when one con- <br />verts 90 days of eight hours of a day into a 24 hour day relationship. <br />Mr. Walsh opposed the change, and appealed to the Council to allow the Sick <br />Leave provision in the Civil Service Rules to remain as it is. He was <br />followed by Mr. Joseph McMahon, president of the International Firefighters <br />Association, who also spoke in opposition to any change and stressed that <br />the change is unfair and inconsistent. He mentioned pending legislation <br />on the F.L.S.A. now before the Supreme Court. <br />Councilman Werner discussed the objective in detail, explaining the thinking <br />behind the proposed change. <br />Mr. Arthur Valentine and Captain Michael Toomey, members of the University <br />City Fire Department, were strongly opposed to the change. They expressed <br />the feeling that they are disillusioned and disappointed in the Council's <br />action this evening. <br />The Mayor called attention to the motion and second on the floor. Upon vote, <br />the motion carried unanimously. <br />
