Session 1120, 11inutes Page 13 <br />December 15, 1975 <br />RESOLUTIONS - SICK LEAVE AND VACATION LEAVE: <br />In response to inquiry by cTayor Kaufman whether there are any resolutions to <br />be presented, Councilman Lieberman said he has two, one relates to Sick <br />Leave and the other to Vacation Leave, as they appear in the Civil Service <br />Rules of University City. Referring to Civil Service Pule X "Attendance and <br />Leaves11, paragraph 4, under Vacation Leave, the first paragraph, he suggest <br />ed the effective date be changed from July 1, 1969 to January 1, 1976; the <br />rest of the first paragraph to remain unchanged; in the second paragraph be- <br />ginning with the words "Vacation time" the portion of a sentence (about the <br />middle of the paragraph) that states "This provision shall come into full <br />force and effect one year from the date of these Rules, and" is to be de- <br />leted and the next sentence will begin with the words, "Any vacation balances <br />in excess of the allowed maximums" and continues without change. <br />In addition, Councilman Lieberman said, he suggests a third paragraph be <br />added which will read as follows: <br />"All references to the previous stated rates of vacation <br />accrual are for regular employees working five days per <br />week on an approximate 40 hour per week schedule. Vacation <br />leave shall be computed on a proportionate basis for regular <br />employees whose average work week is more than 40 hours." <br />Councilman Lieberman said he believes this provides an equity in terms of <br />providing vacation leave for all employees of the City. <br />Councilman Lieberman moved those amendments to the Civil Service Rules be <br />adopted. Motion was seconded by Councilman Glickert. <br />Air. Joseph A. Walsh, member of the University City Fire Department and <br />president of Local #1918, asked whether he understands correctly that this <br />would mean that firefighters would come under this Rule and would receive <br />two weeks and two days, three weeks and three days after ten years and four <br />weeks and four days the same as the other 40 hour employees. <br />City Manager 11,11man explained the impact, pointing out that the firefighters <br />would be receiving a proportionate relationship in terms of the new hourly <br />basis that has been established by the passage of the compensation ordinance <br />of 56 hours which is 140% of the time that the regular employees work in a <br />40 hour week. Leave, depending upon whether length of service is under <br />ten years, or ten to twenty, or over twenty, would be six, nine and twelve <br />24 hour working days. Fie said these figures are derived from a formula <br />which equates -ours of firefighters with 40 hour per week employees. <br />I.1r. Walsh expressed vigorous opposition to the proposed change and urged that <br />the Pules with regard to vacation leave and sick leave for firefighters re- <br />main status quo. Ile told the Council that if this is the only way the fire- <br />fighters are to receive a 56 hour work week, they do not want it. <br />Discussing the rationale for the proposed change, Councilman Werner explained <br />that one of the prime objectives is the reduction in the hours of the fire- <br />fighters and there is no intent to discriminate against the firefighters. <br />Ile said the Council is trying to set this on an equitable basis for the <br />future; as the hours of a week go down, the same proportionate ratio will <br />be applied.
