Session 1265, Minutes <br />December 22, 1980 <br />FIRE DEPARTMENT REPORT <br />Page 5 <br />The Fire Department report for the week of December 7, 1980, through December 13, <br />1980, was received and ordered filed. <br />BILLS FOR ADOPTION AS ORDINANCES <br />BILL NO. 7379 (AS AMENDED) - AMENDING CHAPTER 34 MUNICIPAL CODE RELATING TO ZONING, <br />BY REPEALING ARTICLE IX, AND ENACTING THEREIN A NEW SECTION TO BE KNOWN AS "ARTICLE <br />IX. HISTORICAL FEATURES AND DISTRICTS." <br />Mrs. Metcalfe said a new bill on historical features and districts was to be intro- <br />duced in early 1981, and suggested that Bill No. 7379 be defeated, noting that it <br />has been on the docket for many months and should now be taken off. <br />Mr. Adams moved approval, counseling fellow councilmembers to vote against the bill. <br />Mrs. Metcalfe seconded the motion. Upon roll call, the following vote was recorded: <br />AYES: None. NAYS: Councilmembers Lieberman, Adams, Metcalfe, Kelley, Sabol, <br />Thompson, and Mayor Mooney. <br />BILLS FOR SECOND READING <br />BILL NO. 7468 - GRANTING A FRANCHISE. TO CONTINENTAL CABLEVISION OF ST. LOUIS COUNTY, <br />INC., ITS LAWFUL SUCCESSORS OR ASSIGNS, TO OWN AND OPERATE AND MAINTAIN A CABLE <br />TELEVISION SYSTEM IN UNIVERSITY CITY, MISSOURI, SETTING FORTH CONDITIONS ACCOMPANY- <br />ING THE GRANT OF FRANCHISE, AND PROVIDING FOR THE REGULATION AND USE OF SAID SYSTEM. <br />Bill No. 7468 was given its second reading. <br />Bill No. 7468 was given its third reading. <br />-Mr. Sabol commented on Section 18, page 16 (Public Notice). He said he wished to <br />be certain that notice of public meetings relating to the franchise were published <br />in general circulation newspapers in addition to a legal newspaper and on two chan- <br />nels of the company's CATV system. Mr. Kay said public hearing notices are usually <br />published in either a daily newspaper or in the Clayton Citizen, a local weekly. <br />Mr. Sabol asked for confirmation that the company cannot request a rate increase <br />for at least four years, and Mr. 011endorff said that was correct. Mr. Sabol asked <br />for information about the type of movies to be shown, and was assured that no "X" <br />rated movies will be shown. Mr. 011endorff said the ordinance incorporates the <br />language used by the Supreme Court on this subject, and the City cannot prohibit <br />"R" rated movies from being shown. Mr. Sabol said he would like for the City - <br />company committee, mentioned on page 27, Section 8 h) to be increased from five to <br />seven, so each councilmember will have an appointment. Mr. 011endorff said that <br />this was to be a working committee, its main activity to be the formulation of a <br />budget. He noted that he would have preferred a three-member committee, feeling a <br />smaller number tended to be more efficient. He said he would not like to see a <br />larger number than five. <br />Mrs. Thompson asked about a training program for University City residents, and Mr. <br />011endorff said he had written a memo with information on that matter, which was <br />to have gone to all councilmembers.
