Session 1265, Minutes Page 9 <br />December 22, 1980 <br />Mayor Mooney called for a roll call on Mr. Kelley's motion, with the following re- <br />sult: AYES: Councilmembers Metcalfe and Kelley. NAYS: Councilmembers Sabol, <br />Thompson, Lieberman, Adams, and Mayor Mooney. The motion was defeated by a vote <br />of five to two. <br />Mrs. Metcalfe said she felt Mr. Adams' suggestion was excellent, and that every <br />councilmember who proposed changes in the bill should put them in writing and send <br />to all Councilmembers for their perusal and reaction before the next council meet- <br />ing. She also said she felt that the Council should take as much time as all mem- <br />bers felt was needed, and not try to rush through passage, since the effect of the <br />ordinance will last 15 years and will affect all citizen subscribers. <br />Mr. 011endorff said he felt the Council should continue the discussion of the bill <br />and try to make as much progress as possible at this meeting. <br />On page 16, Article I, Section 17 d), Mr. Kelley moved to add the phrase "lists the <br />names and addresses of such subscribers or" in the third line of the paragraph be- <br />tween the words "which" and "identifies." Mr. 011endorff agreed that amendment <br />should be made. Mr. Schleyer noted that there were times when it was necessary for <br />the company to make labels available to their vendors so they may be put on .,)vie <br />guides, etc., so vendors would get a list, but they are not used for any other pur- <br />pose. Mr. Kelley said he would change his amendment to read "involved to sell any <br />list of the names and addresses of such subscriber or sell or otherwise make avail- <br />able to any party any list which identifies the viewing habits of individual sub- <br />scribers" in the second line after the word "subscriber." Mr. 011endorff concurred. <br />Mrs. Metcalfe seconded the motion. Upon roll call, the following vote was recorded: <br />AYES: Councilmembers Kelley and Metcalfe. NAYS: Councilmembers Sabol, Thompson, <br />Lieberman, Adams,nd Maybr Mooney. The motion was defeated by a vote of five to <br />two. Mr. Adams added that he was in favor of the amendment but would not vote for <br />it until he saw it in writing. <br />Mrs. Metcalfe had comments and possible amendments she wished to make, but said if <br />the Council was not receptive to consideration of those comments unless they were in <br />writing, she would be happy to put them in writing for consideration at the next <br />Council meeting. No one objected to her continuing, although Mr. Sabol and Mrs. <br />Thompson said they were ready to vote on the bill. Mayor Mooney said discussion <br />would continue. <br />Mr. Adams said he felt Councilmembers should submit proposed changes in writing to <br />the rest of the Council, so there will be time to study thoserchanges. He felt <br />this was essential, particularly in a bill of this magnitude of importance to the <br />City and its citizens. <br />Mrs. Metcalfe felt she and Mr. Kelley should put their revisions in writing so both <br />the Council and Continental will have an opportunity to look over the proposed <br />changes and comment on their applicability. She felt the bill needed to rest for <br />-a short time and should not be passed at this meeting under any circumstances. She <br />_ felt much of the public was not aware that the bill was being considered and it <br />would also give them an opportunity to comment. <br />Mr. Sabol said he felt a time limit should be set so the bill can be passed.
