Session 1242, Minutes Page 5 <br />April 14, 1980 <br />Councilmember Adams moved approval. Councilman Sabot seconded the motion, which <br />carried unanimously. <br />CONSIDERATION OF CONDITIONAL.USE PERMIT FOR SERVICE STATION AT 1163 FERGUSON <br />The City Manager said Mr. George Burse applied for a conditional use permit to <br />operate am-automabi,le service station. at 1163 Ferguson. The Plan Commission re- <br />jected the application by a vote of 4 to 1, because the lot size is inadequate to <br />accommodate the type of business proposed, which would be mainly auto repair work. <br />In addi.tion,, the Commission decided that the close Proximity of the station to <br />the residential area would be a negative factor. <br />Councilmember Sabol asked Mr. Goldman, Director of Planning, what type of facil- <br />ities would be suitable at that location. Mr. Goldman said that, although the <br />site has been used as a small filling station for a number of years, the erratic <br />availability of gasoline in small quantities does not make it attractive for use <br />only as a filling station, and because of the smallness of the lot, it cannot ac- <br />commodate the amount of car repair work that would be needed to make an econom- <br />ically viable business. He suggested offices or something of that nature would <br />be acceptable. <br />Mrs. Glickert asked to comment. She said that when the facility was a filling <br />station, there really.was not a problem, but that several years ago, car repair <br />work was being done on the lot, and it was very detrimental to the neighborhood. <br />She said many o.f the neighhors.came to the Plan Commission meeting to object to <br />the dirt,.- <br />noise-and-overcrowding,.-Councilmember Sabol was .concerned about the owner of the property, and Mr. 011en- <br />dorff.said_if he would come into City Hall, every effort would be made to help <br />him locate.a suitable tenant. - <br />After examining the location, Councilmember Adams said he also felt that an auto <br />repair -shop was not suitable for.this lot.. <br />Councilmember Metcalfe said a similar situation existed in her neighborhood with <br />a station too small-to.accommodate.auto repair, and.it has since become very at- <br />tractive .office,s.pace.--Mrs..- Metcalfe moved to deny the. application. <br />Councilmember Lieberman said neighbors of the proposed facility are unanimously <br />opposed to , this_ operati on.. He- seconded Mrs. Metcalfe's motion, which carried <br />unanimously. <br />LOT SPLIT AT-149.NORTH...HANLEY.. <br />The City Manager.said the Council was asked to approve the splitting of a lot at <br />149 North Hanley. Mr. 011endorff said he recommended that this not be approved, <br />since it not only does not meet Zoning Code standards, but the side yard would be <br />less than required (which is 6 feet) and the building overhang would be at or be- <br />yond the new property line. Approval would be legally questionable and totally <br />improper from a planning point of view. The Plan Commission did approve this in <br />a split vote. <br />
