CERTIFICATION OF INSUFFICIENCY OF TAX PETITION <br />I, Dolores A. Miller, Acting City Clerk, do hereby state that I have received a peti- <br />tion denominated "gross receipts tax initiative petition." I further state that I <br />forwarded to the St. Louis County Board of Election Commissioners the petitions which <br />I received. On December 3, 1979, I requested of this Council, at its regular Council <br />meeting, held on that day, a legal opinion as to whether the petition may be acted upon <br />by the Council. I am in receipt of that legal opinion, and based on that opinion, I <br />certify to this Council the following: <br />1. That each paper of the petition has the proper statement of the circulator. <br />2. The number of qualified electors, as certified by the St. Louis County Board of <br />Election Commissioners, who signed the petition, aggregated 2,491. <br />3. As certified by the St. Louis County Board of Election Commissioners, the total <br />number of registered voters in University City is 24,435. Thus, the number of <br />qualified signatories on the petition represents 10.194% of the registered voters <br />at the last regular municipal election. <br />4. It is in fact a referendum petition which was not timely filed within fifteen days <br />after June 25, 1979, when the taxing ordinances which the petition seeks to repeal <br />were enacted. <br />5. It is in fact a referendum petition which has not been signed by at least fifteen <br />percentum of the registered voters at the last regular municipal election. <br />6. It is in fact a referendum petition which seeks to repeal tax ordinances specifi- <br />cally exempted from the referendum power. <br />7. Its subject matter deals with the taxing power and, as such, is beyond the scope <br />of both the initiative and referendum provisions in the Charter. <br />8. I hereby certify that I will immediately notify the persons filing the petition <br />of my findings in accordance with Section 76 of the University City Charter. <br />
