Mr. Lai stated that Sinan Alpaslan, the City Engineer, is in attendance and questions may <br />be directed to him regarding floodway issues. <br />Mr. Alpaslan provided an overview of the comments from the Public Works Department. <br />-If over time we have another flood, would these people be in danger? Safety is a <br />concern. Ms. Riganti – We have no evidence at this time that it is a legal non- <br />conforming use. Mr. Li stated that he has seen the highest flooding on this property and <br />the water does not rise much. <br />-If the building has seven residential units, how large are they? Mr. Li – Not completely <br />decided yet. They will not be for families. They will be for one person. <br />-A survey needs to be completed to show the floodway boundary, correct? Ms. Riganti – <br />A survey would need to be completed by the time the Final Development Plan is <br />submitted. Mr. Greatens – If rezoned, nothing can be done until the Final Development <br />plan is approved. Ms. Riganti – They would have to get an elevation certificate. The <br />survey would depict the boundary of the floodway and floodplain. The Public Works <br />Department would then determine which regulations apply. It follows a similar <br />procedure as the Preliminary Plat and Final Plat for a subdivision. The Final <br />Development Plan will require more detailed drawings. <br />-Once it is rezoned, it is just rezoned? Ms. Riganti – When rezoning to a PD District, the <br />development plan is tied to the zoning. The applicant cannot do anything until the Final <br />Development Plan is approved. Mr. Greatens – Any conditions are associated with the <br />Plan. Ms. Riganti – Conditions are set forth in the resolution. <br />-In a commercial area like The Loop or Olive, when applicants propose commercial on the <br />first floor, a Conditional Use Permit is required for restaurants in The Loop, but not on <br />Olive. Why? There are not many residential areas on Olive. Ms. Riganti – There are <br />other residential locations along Olive. We are trying to increase our City’s population. <br />This can be done by adding more residential uses on Olive. <br />-We are trying to attract mixed-use developments. <br />The Chairperson asked if there were any more questions. There being none, the Chairperson <br />asked for a motion. <br />Ms. Greening made a motion to approve the Zoning Map Amendment with the attached <br />resolution. The motion was seconded by Mr. Halpert. <br />Ms. Carr stated that until we are certain it is not in a floodplain, particularly not in a floodway, <br />she will not vote for approval of the rezoning request. She stated she would like to give time to <br />Mr. Li to find out. <br />Ms. Greening withdrew her first motion. <br />Ms. Greening made a motion to postpone the hearing on the Zoning Map Amendment until the <br />April 27 Plan Commission meeting.
