The Chairperson requested that Staff provide Mr. Hassenstab with a copy of the material referred <br />to. <br />Mr. Lai – Mr. Hassenstab can contact our department. <br />Zoning Map Amendment – 8162 Olive Boulevard <br />The Chairperson stated that a letter was received from the applicant requesting that the Plan <br />Commission postpone the item until the May 25, 2011 meeting. The applicant is waiting on a <br />surveyor to prepare a new site plan. <br />A motion was made to postpone the agenda item until May 25, 2011. The motion was seconded. <br />The motion passed. <br />Text Amendment <br />The Chairperson provided background information about the proposed Text Amendment and <br />stated that the Zoning Code Review Committee met previously and discussed the proposal with <br />staff. Staff has provided the Text Amendment in the agenda packets. City Council requested <br />that we address the Zoning Code and how to limit check-cashing establishments. We reviewed <br />the proposed Text Amendment with staff and staff researched the issue. We then discussed ways <br />to amend code and carry out Council’s request. Has the Commission been able to review the <br />information in the packet? <br />The Plan Commission members concurred that they were ready to discuss the proposed Text <br />Amendment. <br />The Chairperson requested that the staff provide a summary of the proposal. <br />Mr. Greatens – The purpose of the proposed Text Amendment is to strengthen the Zoning <br />Ordinance in terms of check-cashing establishments, short-term loan establishments, and title <br />lenders, all three of which are defined in the ordinance. <br />Question <br />-What problems did City Council want to solve with this? <br />Mr. Greatens – This originated at a public meeting in February, led by Rep. Ellinger, discussing <br />the dangers of pay day loans stores. These businesses offer high interest loans, etc. Council <br />wanted to provide more protection from these businesses. There are four existing short-term <br />loan establishments. They are regulated by the State, so there is no way to exclusively prohibit <br />them. There are ways to restrict them. Mr. Greatens explained where the four existing short- <br />term loan establishments are located and also the two check-cashing establishments. There are <br />six total businesses of this type. All four short-term loan establishments are in the GC District. <br />They located there prior to being only permitted in the IC District as a conditional use. In 2002, <br />the Code was amended to regulate short-term loan establishments to the IC District only as a <br />conditional use. All existing short-term loan establishments operate as legal non-conforming <br />uses. Check-cashing establishments were not addressed in that text amendment which is another <br />tm;E <br /> <br />
