Code Sections including but not limited to Zoning Code Section34-36.5.4. By doing that we are <br />referring back to the Zoning Code which allows some flexibility and does not use the words shall <br />or should. It would be stating that If 5,000 square feet of open space is being lost, it should be <br />replaced with these type of features. <br />Mr. Senturia suggested that the applicant be given some options to choose from in a list. <br />Mr. Halpert stated that his concern is that it complies with the Zoning Code. <br />Mr. Dabler stated they have some concern about limitations if it is up to the Director of <br />Community Development to approve the landscape plan. <br />Mr. Greatens added that the Plan Commission does have the authority to go beyond what the <br />Zoning Code requires because it is a Conditional Use Permit. <br />Mr. Byrne stated he does not like how it uses the term “and” not “or” and suggested it be <br />changed to “or” or perhaps “and/or.” It is currently a complete list of examples using the word <br />“shall”. <br />Mr. Senturia suggested using the wording “incorporate features such as…” <br />Mr. Dabler asked about guidance provided in the Zoning Code and if there is a quantitative <br />measurement. <br />Mr. Lai stated that the developer should go beyond the minimum requirements due to loss of <br />open space. Specific numbers might not work. If there are areas that a tree cannot be located, <br />that is fine. Staff will look for places that are appropriate and will add to the aesthetics of the <br />property as well as those that will not be a safety concern. Mr. Lai also mentioned some specific <br />locations including along Delmar and Delcrest as well as areas along the residential property. <br />Mr. Lai added that the Code requires a wall or fence along the property line and that the <br />developer has applied for a variance. <br />Mr. Halpert asked for any comments from the public. <br />Sara Hanley with the University City Bike-Walk Task Force asked about parking around the <br />Walgreens building. <br />Mr. Greatens stated the Zoning Code requirements. <br />Mr. Lai added that if medical offices are included in the proposed office building, additional <br />parking is required because the parking requirements are stricter for medical offices as opposed <br />to general offices. <br />Mr. Byrne proposed the following language for Condition 2 in Attachment A of the Staff Report: <br />tm; E <br /> <br />
