<br />Mr. Kraft Called the Question. Mayor Welsch called for a voice vote of all those in <br />favor of calling the question and it carried unanimously. <br /> <br />The voice vote on accepting the contract with Avant’s carried with the majority <br />voting to accept the Avant Marketing Group Agreement with two NAY votes from <br />Mr. Crow and Mr. Price. <br /> <br />3. <br />Ruth Park Golf Course Concrete Cart Path extension. <br />Mr. Walker said that staff recommended awarding the contract to Tom Adair <br />Construction in the amount of $49,950 for option 2. <br /> <br />Mr. Price moved for approval and was seconded by Mr. Crow. <br /> <br />Mr. Glickert asked if Mr. Ewald Winker could enlighten Council as to what path is <br />going to be part of this addition. <br /> <br />Mr. Winker, Interim Director of Parks, Recreation and Forestry, stated they are close <br />to the end of the cart path project. After this work is completed they will be 250 feet <br />away from completing all of number three. He said if they could budget another <br />$250,000 for next year, they will have completed all of the concrete cart paths. <br /> <br />Voice vote on approving the contract with Tom Adair carried unanimously. <br /> <br />Mr. Kraft recused himself from items 4 and 5 on the City Manager’s calendar. <br /> <br />4. <br />Conditional Use Permit application for 8390 Delmar/Kent Evans; new retail <br />establishment with drive-through facilities in General Commercial District. <br /> <br />Mr. Walker noted that Council would find an update placed on their desks that he <br />would address shortly. He said in summary this application is for conditional use <br />permit to allow a drive-through facility to a proposed new retail establishment, <br />essentially a Walgreens. Mr. Walker said the retail is a permitted use in a retail <br />zoning district, however a drive-through facility requires a conditional use permit <br />which is why it was before Council. The site plan as required was submitted to the <br />Plan Commission. He said that the applicant is requesting to reduce the landscape <br />buffer depicted in the site plan from ten feet to eight feet which is supported by the <br />Plan Commission and staff. Mr. Walker noted the zoning code permits the City <br />Council to reduce landscaping requirement by up to twenty percent. He stated <br />there would be a new traffic signal at Delmar and Delcrest in conjunction with the <br />development. The Traffic Commission approved the new signal at their July 13 <br />meeting. Mr. Walker pointed out that as far as the Plan Commission’s <br />recommendation; there is no limitation to the hours of operation. He recommended <br />approval of the Conditional Use Permit with one change relating to staff’s point of <br />view that there might be the option to move the building closer to Delmar that may <br />or may not be possible, so would like farther discussions with the developer on it. <br /> <br />Mr. Crow moved to approve the Conditional Use Permit with conditions as approved <br />by the Plan Commission in attachment A and was seconded by Mr. Glickert. <br /> <br /> 6 <br /> <br /> <br />
