Mr. Price asked if that approval approved the 24-hour operation and Mayor Welsch <br />said it did. <br /> <br />Ms. Ricci asked to verify that if Walgreens does not go through with it, the <br />Conditional Use Permit (CUP) expires. Mr. Walker agreed. <br /> <br />Mr. Sharpe asked to verify that the building as submitted would remain the same as <br />the original location if it is found that they cannot move it forward; Mr. Walker <br />agreed. <br /> <br />CITIZEN COMMENTS <br />Paulette Carr, 7901 Gannon <br /> <br />Ms. Carr stated as a member of the Plan Commission, that the Plan Commission <br />unanimously passed the development plan. She was shocked that the new plan did <br />not have to go back through the Plan Commission. Ms. Carr stated the conditions <br />of attachment A, the staff altered the vote upon policy of the Plan Commission. The <br />policy was asking for the 24-hours that Walgreens be able to be in operation. Ms. <br />Carr stated that the Mayor has unilaterally decided this plan should be altered <br />without getting advice from the Council. She stated the Mayor has directed staff to <br />change the Plan Commission’s proposal to Council. Ms. Carr said the light the City <br />has been trying to get moved will now be moved and paid for by the developer. She <br />said with the movement of the light, it made other land valuable for sale for <br />additional development <br /> <br />Mayor Welsch asked for the City Clerk to let the records show that once again Ms. <br />Carr has stated things that are not true. The Mayor said she has in no way directed <br />staff to do anything on this issue. Mayor Welsch said she would like the record to <br />clearly show that, once again, things are being said at the podium that have no <br />basis in fact.. <br /> <br />Frank Ollendorff, 8128 Cornell Ct <br />Mr. Ollendorff was representing Jakob Medve, the owner of the property, subject of <br />the CUP. Mr. Medve also is the owner of the apartments and the Mansions <br />adjacent to the proposed site. Mr. Ollendorff objected to and opposed the attempt to <br />add a last minute deal killing change of rule of moving the building closer to Delmar. <br />He noted the developer had previously demonstrated conclusively to the staff that it <br />was not practical to move the building towards Delmar. Mr. Ollendorff said it would <br />negatively affect the residents of the apartments to the east by cutting off the open <br />air, lights and open view to the west. Secondly he said it would be a deal killer by <br />denying full value for the owner’s property and will cost the city a 30 million dollar <br />development, discussed for the last seven months and unanimously approved. Mr. <br />Ollendorff said up until two weeks ago, for the first time in his 45 year career, where <br />a last minute substantial condition was added to the CUP approved by the Plan and <br />Traffic Commissions. He said the owner and developer have spent 11 months and <br />over $100,000 in an effort to meet every requirement of the City. Mr. Ollendorff said <br />the deal killing illogical substantial change must not be adopted. He said they <br />recognize the staff has the legal authority to impose whatever conditions they <br />please and ask that this authority not be abused. Mr. Ollendorff asked that it be <br />considered that there are costs to pay for such decisions and the biggest being a <br /> 7 <br /> <br /> <br />
