challenge to the integrity of University City’s Planning and Development program <br />and process. Mr. Ollendorff said since this deal killing change was proposed, a <br />potential partner in the Mansions’ phase two has said if this is the way University <br />City acts it is not a place where he would be comfortable in investing his time and <br />money. A developer interested in Delcrest School Administrative Building project is <br />watching to see if University City is a trust-worthy partner for development. Mr. <br />Ollendorff urged the Council to accept the Plan Commission’s conditions previously <br />agreed on by all parties, rather than the new condition proposed this evening. <br /> <br />Ben Halpert, chairman of University City Planning Commission, 510 Donne Ave <br />Mr. Halpert noted that the letter in Council’s packet is written to show that it was <br />sent by him, was the first time he had seen it. He did note that the material <br />following the letter was what the Plan Commission had approved with no limitations <br />in respect to business operating hours. He said the concern he has with the <br />proposed changes was, if the City had the authority to do so. Mr. Halpert also <br />questioned whether the staff has the permission to change the CUP at this late <br />date. It was his opinion that if the application was approved by the Plan <br />Commission in June then changes before Council now are not proper. He was <br />concerned that Walgreens would walk away from the deal and would be another <br />travesty for the City. <br /> <br />Joe Downs, Heartland Bank, 212 S. Central <br />Mr. Downs noted Heartland Bank is the property owner of 8342 Delcrest, a 5.9 acre <br />parcel that contains the elementary school behind the proposed development. He <br />said the Walgreens proposal with the new traffic signal had spurred interest in the <br />property owned by the bank. <br /> <br />Richard Dockett, 6844 Crest Ave <br />Mr. Dockett said the Walgreens developer is right on track with their proposal. He <br />said they should be fully supported. <br /> <br />Mr. Price asked about the letter sent by Mr. Halpert that he said he did not write or <br />sign as to where it came from and how was it created. <br /> <br />Mr. Walker noted that it is a standard letter that has been used to transmit material <br />from the Plan Commission to the Council for several years. He said it was <br />unfortunate the Chairman was not advised of the use of this standard letter with <br />standard wording. <br /> <br />Mr. Price Called the Question. Mayor Welsch asked for a roll call vote on the Call <br />the Question. <br /> <br />Roll Call vote: <br />AYES: Mr. Price <br />NAYS: Mr. Glickert, Mr. Sharpe, Ms. Ricci, Mr. Crow, Mayor Welsch <br /> <br />Call the Question failed. <br /> <br />Ms. Ricci asked if what was in their packet was what the Plan Commission <br />approved. Mr. Walker said it was and also placed on their desks was a proposal by <br /> 8 <br /> <br /> <br />
