<br />Mr. Mulligan said the only rate that was changed was the commercial rate. He said when an <br />ordinance is amended not in total the better practice is to restate the particular subsection <br />as opposed to just the one change. <br /> <br />Ms. Ricci said the better practice would be to recite there was an error and the bill does not <br />say that. She noted that all rates were referenced in Section 1. <br /> <br />Mr. Mulligan referred Ms. Ricci to the Title of the bill. <br /> <br />Ms. Ricci moved to amend Section 3 so it read in total “It is hereby declared that an <br />emergency exists in that the City must immediately change said commercial property tax <br />rate so that all rates comply with Missouri law and levy a tax at the rates certified by the <br />State Auditor.” <br /> <br />Mr. Mulligan’s concern with that verbiage was basically the City is changing the other two <br />rates that were passed before October 1, instead say that all three come within the ceiling <br />established by Missouri law. <br /> <br />Mr. Mulligan suggested the language that may be considered was “It is hereby declared that <br />an emergency exists in that the City must immediately change commercial property tax rate, <br />so that such rate and all other property tax rates comply with Missouri law.” <br /> <br />Ms. Ricci moved to amend Bill 9138 to state what Mr. Mulligan proposed and was seconded <br />by Mr. Glickert. <br /> <br />Roll Call vote on amendment <br />AYES: Ms. Ricci, Mr. Kraft, Mr. Crow, Mr. Glickert, Mr. Sharpe and Mayor Welsch <br />NAYS: none <br /> <br />Mr. Sharpe moved to approve bill as amended and was seconded by Mr. Glickert. <br /> <br />Roll Call vote was: <br />AYES: Mr. Kraft, Mr. Crow, Mr. Glickert, Mr. Sharpe, Ms. Ricci and Mayor Welsch <br />NAYS: none <br /> <br />Mayor Welsch asked Council to send suggested amendments in before meeting so all <br />members can review them prior to the meeting. <br /> <br />Ms. Ricci stated for the record that she had sent it in ahead of the meeting. <br /> <br />Mr. Sharpe moved to adjourn the Special meeting to go into a study session for discussion <br />on the proposed new firehouse was seconded by Mr. Glickert and carried unanimously. <br /> <br />Special Session was adjourned at 6:20. <br /> <br /> <br />Joyce Pumm, MRCC <br /> <br /> 2 <br />
