<br /> <br />Mr. Price noted that everyone falls under the City Manager. He said there is no procedure <br />connected with this bill and it does not follow protocol. Mr. Price asked Mr. Kraft where his <br />legal opinion came from. He asked that Mr. Kraft provide him with a written report of where <br />his legal advice came from. <br /> <br />Mr. Sharpe noted he was disappointed with the poor procedure and should have had <br />perimeters and procedures in place first. <br /> <br />Ms. Ricci stated the proper procedures have not been done by the City for awhile as in <br />budget transfers. She noted the Charter does not talk about a City Attorney. Ms. Ricci <br />noted the powers of the Council in Section 17 (2). This bill is just changing an ordinance <br />and is nothing against Mr. Mulligan. She said the Charter never envisioned a life time <br />appointment and change is not bad and should be by a majority vote. <br /> <br />Mr. Price said this is just giving Council an expansion of their power. He said the City <br />Attorney is being compromised by the Council. <br /> <br />Ms. Ricci noted the job of the Council is to advise this body to fulfill their obligation. She <br />said independent legal advice whether good, bad or ugly; you don’t want a yes person. Ms. <br />Ricci said to make a good decision it is a matter of process. <br /> <br />Mr. Crow felt the City Attorney is to give advice to the City Manager. <br /> <br />CITIZEN COMMENTS <br />Jan Adams, 7150 Cambridge <br />Ms. Adams was in favor of the Council hiring the City Attorney, as it is detrimental for the <br />Council to be transparent. She stated she witnessed this when City Manager told City <br />Attorney that seeking his advice can only be obtained by going through the City Manager, <br />and has resulted in costing the City money. Ms. Adams noted that as a member of the Civil <br />Service Board, she had requested to speak to the City Attorney and was ignored. <br /> <br />Rod Jennings, 1306 Mt. Olive <br />Mr. Jennings noted the Supreme Court Justice was appointed for life. The Charter is like <br />the constitution. He felt it worked better with the City Manager in charge. <br /> <br />ROLL CALL VOTE was: <br />AYES: Ms. Ricci, Mr. Kraft, Mr. Glickert, and Mayor Welsch <br />NAYS: Mr. Crow, Mr. Sharpe and Mr. Price <br /> <br />Bill 9074 passed by a majority and became ordinance 6816. <br /> <br /> <br />3. <br />BILL 9075 – An ordinance repealing Ordinance No. 6810, and approving the first <br />amendment to the redevelopment agreement for the Kingsland Walk redevelopment area, <br />and authorizing certain actions by city officials. <br /> <br />Mr. Glickert moved to postpone this bill until the August 30 Regular Council meeting, was <br />seconded by Mr. Sharpe and approved unanimously. <br /> <br /> <br /> 6 <br /> <br />
