Session 1668, Minutes <br />June 3, 1996 <br /> <br />Page 4 <br /> <br />to expand the auto repair business at 6300 Delmar since it is contrary to the zoning ordinances and com- <br />prehensive plan for this pedestrian oriented retail/restaurant neighborhood. Earlier plans have also been <br />rejected, and present as well as past operators have shown that such use cannot be carded out in compli- <br />ance with City regulations. <br /> <br />Mr. Richard Byrd, 7801 Forsyth, attorney representing Loop Automotive, 6300 Delmar, said the Circuit <br />Court found that the activities of this business constitute a prior non-conforming use that is a protected <br />property right. He suggested that the operator, Mr. Feygelman, is not in violation of City ordinances. <br />He said Council's choice is not whether they want an auto repair facility at the site, but whether they <br />want it to remain as is or see it upgraded. He said the facade would be improved and the building ex- <br />panded so that cars now parked outside would be inside, and landscaping will be added. Although some <br />feel the repair facilities now diminish the neighborhood, improving the facility will have a less negative <br />effect on the neighborhood, he said. <br /> <br />Mrs. Thompson suggested that action on this be delayed until Mr. Feygelman can meet with staff to <br />see if other improvements can be made in the operation. <br /> <br />Mr. Wagner asked if this change will engender an increase in the volume of this business. Mr. Byrd said <br />the volume could not be increased at this time as it is saturated. <br /> <br />In response to Mr. Munkel, Mr. Byrd said most of the current outside parking spaces would be enclosed <br />when the building is improved. He displayed a rendering of the proposed enlargement. He also provided <br />a letter signed by several residents who support the expansion. <br /> <br />Mr. Schoomer concurred with the findings of the Plan Commission and staff--the facility is not in con- <br />formity with either the Comprehensive Plan or plans for the Loop and would be deleterious to that area. <br /> <br />Mrs. Thompson moved to table, and Mr. Wagner seconded. All voted Aye except Mr. Schoomer and <br />Mr. Munkel, who voted Nay. <br /> <br />SITE PLAN - 8308 OLIVE <br /> <br />The City Manager recommended approval of a site plan for Metro Theater Company to utilize 8308 <br />Olive for their home office, storage, and play development activities. Their rental will not remove the <br />property from the tax rolls. <br /> <br />Mrs. Thompson moved approval. Mr. Ware seconded the motion, which carded unanimously. <br /> <br />SITE PLAN - 7400 OLIVE <br /> <br />The City Manager said a revised site plan was submitted on May 16, 1996, for 7400 Olive. The last plan <br />had several problems, the major one being density. Other issues involve refuse collection vehicles and <br /> <br /> <br />
