Session 1662, Minutes <br />April 8, 1996 <br /> <br />Page 4 <br /> <br />Mayor Adams closed the public heating at 7:50 p.m. <br /> <br />CONDITIONAL USE PERMIT - 6319 DELMAR <br /> <br />The Deputy City Manager said a three-story 140 space parking garage was authorized by the 1994 bond <br />issue on the parking lot at 6319 Delmar. There will be four retail stores at ground level with parking <br />behind the stores and on the two upper floors. The following conditions will apply: <br /> <br />1. Sideyards shall comply with Zoning Code Section 34-36.6c unless otherwise approved by the Board <br /> of Adjustment. <br />2. The right-of-way setback requirement shall be waived. <br />3. Signs shall be installed and maintained in accordance with the requirements of the Zoning Code. <br />4. Lighting fixtures shall be shaded wherever necessary to avoid casting direct light upon any property <br /> located in a residential district. <br /> <br />Mr. Schoomer noted this project was unanimously approved by the Plan Commission. He moved ap- <br />proval. Mr. Wagner seconded the motion, which carded unanimously. <br /> <br />CONDITIONAL USE PERMIT - 6841 OLIVE <br /> <br />The Deputy City Manager said the City Manager concurs in the Plan Commission recommendation to <br />approve a carryout restaurant at 6841 Olive, with the following conditions: <br /> <br />1. Primary signage shall be limited to a single wall sign mounted above the display window and not ex- <br /> ceeding 25 square feet in gross sign area. <br />2. A detailed landscaping plan shall be submitted to the Director of Planning for his review and approv- <br /> al. Landscaping shall be installed and maintained in accordance with the approved plan. <br />3. Adequate refuse disposal shall be provided by and for the business. Outdoor storage of refuse con- <br /> tainers shall be as approved by the Director of Planning. <br />4. An exhaust system shall be installed and maintained or other means shall be taken to prevent food <br /> preparation odors or cooking odors from being readily perceptible beyond the lot lines of the prop- <br /> erty on which the restaurant is located. <br />5. Hours of operation shall be limited to between 9:00 a.m. and 11:30 p.m., except on Fridays and Sat- <br /> urdays the hours of operation shall be limited to between 9:00 a.m. and 1:30 a.m. the next morning. <br />6. The operator of the restaurant shall regularly police the site and the area adjacent to the restaurant <br /> to remove litter and debris. <br /> <br />Mrs. Thompson moved approval.
