Session 1662, Minutes April 8, 1996 Page 4 Mayor Adams closed the public heating at 7:50 p.m. CONDITIONAL USE PERMIT - 6319 DELMAR The Deputy City Manager said a three-story 140 space parking garage was authorized by the 1994 bond issue on the parking lot at 6319 Delmar. There will be four retail stores at ground level with parking behind the stores and on the two upper floors. The following conditions will apply: 1. Sideyards shall comply with Zoning Code Section 34-36.6c unless otherwise approved by the Board of Adjustment. 2. The right-of-way setback requirement shall be waived. 3. Signs shall be installed and maintained in accordance with the requirements of the Zoning Code. 4. Lighting fixtures shall be shaded wherever necessary to avoid casting direct light upon any property located in a residential district. Mr. Schoomer noted this project was unanimously approved by the Plan Commission. He moved ap- proval. Mr. Wagner seconded the motion, which carded unanimously. CONDITIONAL USE PERMIT - 6841 OLIVE The Deputy City Manager said the City Manager concurs in the Plan Commission recommendation to approve a carryout restaurant at 6841 Olive, with the following conditions: 1. Primary signage shall be limited to a single wall sign mounted above the display window and not ex- ceeding 25 square feet in gross sign area. 2. A detailed landscaping plan shall be submitted to the Director of Planning for his review and approv- al. Landscaping shall be installed and maintained in accordance with the approved plan. 3. Adequate refuse disposal shall be provided by and for the business. Outdoor storage of refuse con- tainers shall be as approved by the Director of Planning. 4. An exhaust system shall be installed and maintained or other means shall be taken to prevent food preparation odors or cooking odors from being readily perceptible beyond the lot lines of the prop- erty on which the restaurant is located. 5. Hours of operation shall be limited to between 9:00 a.m. and 11:30 p.m., except on Fridays and Sat- urdays the hours of operation shall be limited to between 9:00 a.m. and 1:30 a.m. the next morning. 6. The operator of the restaurant shall regularly police the site and the area adjacent to the restaurant to remove litter and debris. Mrs. Thompson moved approval.
