Session 1702, Minutes <br />July 28, 1997 <br /> <br />Mr. Rudolph Oppenheim, 7561 Etzel, is the president of the cemetery association. The water situation has always plagued <br />them since they are landlocked in a small parcel of land. He has talked to the potential buyer and they said that there would <br />be no problem and he is hopeful that it can be worked out between them. There is a water line on the outside o fthe <br />building that they have used for years when it was occupied by the JCCA and the Rabbinical College. It is not a big deal, but <br />they would like to work out a deal where a tap off line can be laid off of the water line or whether the cemetery could put in <br />their own water meter. Responding to Mr. Wagner, Mr. Oppenheim said that he was comfortable with the site plan. <br /> <br />Mr. Munkel said he was not comfortable with the site plan, because in the parking area they have blocked offa corner to <br />make it look better, but the main entrance to the cemetery has a gate that is towards the west end of the cemetery. He <br />knows that there are still spaces in this cemetery to be used. With the existing site plan, if the parking was rearranged and <br />the corner removed and made parking, there could be direct access to the cemetery. Mr. Munkel asked Mr. Oppenheim <br />how he felt about that idea. Mr. Oppenheim said that the entrance faces north toward Olive and in the original deed they <br />were given an egress and ingress of twenty feet. In the case of a funeral, the Asape group has given them permission to use <br />the parking lot. He really sees no problem, unless they were to build on that parking lot. <br /> <br />Mr. Wagner asked the Mayor to please ask the applicant to come forward. <br /> <br />Ms. Yvonne Griffin, 17819 Archon Estates, St. Louis, the applicant, responded to Mr. Wagner's question about cooperating <br />with the cemetery association in regards to access and providing water supplies. Ms. Griffin said that they understand the <br />sanctity of a cemetery, being a Christian school, and would be happy to provide the cemetery with the access and water <br />that they need. They are in agreement as to how this should be handled and will put the agreement in writing to satisfy <br />Council. The school will be notitied in advance of funerals and the school will move cars to accommodate the cemetery. <br /> <br />Mr. I ieberman said that the Planning staff did not know whether or not the Agape organization was tax exempt or not and <br />he asked Ms. Griffin to clarify. Ms. Griffin said that they are a 501 c3, which means that they are a tax exempt institution. <br />Secondly, Mr. Ueberman mentioned the matter of the easement. The Planning staff had recommended that an easement <br />or a written agreement be recorded with the Recorder of Deeds. Ms. Griffin responded that they only have a verbal <br />agreement right now, but that they would file the agreement with the Recorder of Deeds when they close on the property <br />next week and will send a copy to Council. Mr, Ueberman said that the question was asked whether or not she was aware <br />that quite a bit of work on the building was required in order to meet the City building and property maintenance codes <br />before the building could be occupied. Ms. Griffin said that she was aware of this requirement. For the benefrt of the <br />Council, Mr. Ueberman said that the only comment made by the public was a lady named Mrs. Walker who lives behind the <br />property. She was asking about a wooden privacy fence. Ms. Griffin said that there would be a wooden privacy fence, not <br />only because of the neighborhood requirements, but for the safety of their children. Mr. Lieberman reported that Mrs. <br />Walker did not think a wood fence was as attractive as a chain link fence and that there were several Plan Commission <br />members who disagreed with her. <br /> <br />Mr. Schoomer said that this property, in the past, had been found to contain asbestos and lead paint and asked Ms. Griffin if <br />she was prepared to take full responsibility for the abatement of these materials. Ms. Griffin said that they were prepared to <br />take full responsibility for the property. <br /> <br />Mr. Oppenheim wished to add that there was an easement recorded on their deed of twenty foot, however it is not <br />recorded exactly where that easement would be, but it is from Olive Street Road to the cemetery. <br /> <br />Mr. Schoomer moved approval of the conditional use of 7400 Delmar with conditions as set forth by the Plan Commission. <br />Mr. Ware seconded the motion which carried unanimously. <br /> <br /> <br />
