<br />RES 2006 - 8 <br /> <br />RESOLUTION <br /> <br />The matter of determining the order in which City Council candidates' names shall <br />appear on the ballot was considered. <br /> <br />After a review and general discussion of the matter, Councilmember Price offered <br />the following resolution and moved its adoption. <br /> <br />BE IT RESOLVED: That the Council of the City of University City, Missouri finds <br />and declares as follows: <br /> <br />1. Section 115.124.2 RSMo provides that in any nonpartisan election where a <br />city is responsible for the oversight of the filing of candidates, the city <br />shall clearly designate where candidates shall form a line to effectuate <br />such filings and determine the order of the filings; except that, in the case <br />of the candidates who file a declaration of candidacy with the city prior to <br />5:00 p.m. on the first day for filing, the city may determine by random <br />drawing the order in which the candidates' names shall appear on the <br />ballot. Said statute further provides that if a drawing is conducted: it shall <br />be conducted so that each candidate may draw a number at random at the <br />time of filing; the city shall record the number drawn with the candidate's <br />declaration of candidacy; and the names of candidates filing on the first <br />day of filing for each office on each ballot shall be listed in ascending <br />order of the numbers so drawn. <br /> <br />2. Under University City Charter Section 68, a declaration of candidacy shall <br />be made by filing a nominating petition and a signed acceptance of the <br />nomination with the City Clerk. Within ten days after the filing of a <br />nominating petition, the City Clerk must notify the candidate whether or <br />not the petition is sufficient. If the petition is found insufficient, the City <br />Clerk must return it immediately to the person who filed it with a <br />statement certifying wherein the petition is found insufficient. Within the <br />regular time for filing petitions a new or supplemental petition may be <br />filed for the same candidate. <br /> <br />3. The City of University City, Missouri shall determine by random drawing <br />the order in which the City Council candidates' names shall appear on the <br />ballot, for candidates who file a declaration of candidacy with the City <br />Clerk prior to 5:00 p.m. on the first day for filing, as provided in Section <br />115.124.2 RSMo. <br /> <br />4. Each candidate who files a declaration of candidacy with the City Clerk <br />prior to 5:00 p.m. on the first day of filing may draw a number at random <br />
