He will stick by his motion and urge a vote of denial on this and <br />then come back with a better instrument to vote on. <br /> <br />Mayor Adams said that he would support a change that would not be precedent setting, in order to deal with each request <br />individually. He would not like to see fifty requests coming before Council. <br /> <br />Mayor Adams called the question, which was "Shall Council vote to deny the conditional use amendment?". Mr. Wagner <br />and Mr. Munkel voted Aye, except Mr. Ware, Mr. Lieberman, Mr. Schoomer and Mrs. Thompson, who voted Nay. The <br />motion failed two to four. <br /> <br />Mr. Schoomer made a motion to approve the conditional use permit. Mr. Lieberman seconded the motion. All voted aye, <br />except for Mr. Wagner and Mr. Munkel who voted Nay. The motion carried four to two. <br /> <br />AGENDA ITEM//4 - REZONING PUBLIC HEARING DATE FOR 501-515 NORTH & SOUTH: <br /> <br />Mr. Ollendorff reported that Council was asked to set a public hearing date to rezone three lots on the west side of North & <br />South Road, north of the City limits with Clayton. The proposal is to rezone from single family to planned development. <br />The Plan Commission recommends approving this rezoning. The Council's past policy, in this zoning category, is not to <br />approve rezoning until an acceptable site plan has been reviewed. In this case, the site plan is not recommended for <br />approval and the developer is interested in revising it. Never the less, there is no harm in setting a public hearing date, <br />which can be set for July 28, 1997 at 7:30 p.m. in the Council Chambers. <br /> <br />Mr. Ueberman moved approval of setting the Public Hearing date. Mr. Munkel seconded the motion, which carried <br />unanimously. <br /> <br />Mayor Adams directed the City Manager to make sure that the appropriate people are notified of this public hearing and that <br />the same people that were at the last public hearing, dealing with the property across the street, were also sent the <br />information. <br /> <br />Mr. Schoomer also requested the City Manager to have his staff check for clear indication of ownership of this property <br />before Council considers any change in zoning. <br /> <br />PERSONNEL REPORT <br /> <br />The Personnel report for the period ending July 7, 1997, was received and ordered filed. <br /> <br />CITI7EN COMMENTS: <br /> <br />The Mayor called forward citizens who wished to speak on non-agenda issues. <br /> <br />Mr. Alex Feldman, 1233 Backer St., wished to make a comment about the proposed nursing home to be built at the Delta <br />Dental site. He said that presently state law has provided a moratorium on nursing homes in Missouri, because there are <br />too many. One can be built under certain conditions, however. One of these conditions is to serve an ethnic group. At <br />the nursing home at # I McKnight Place, the developers used that option as a reason for overcoming the moratorium on <br />nursing homes. They have to come before Council and apply for a permit to build. Everything is line and legal, however; <br />there reasoning for having a nursing home here is that it will serve the Jewish people. They also use that same reasoning for <br />opening up the nursing home at # I McKnight Place. Mr. Feldman said that he has nothing against that, however; they are <br />forgetting that the Jewish population in University City is seventeen percent in poverty. He had said to Mr. Deutsch that <br />they should make some room for some Medicaid beds. The developers told him that the clientele would not be that way. <br />He told Mr. Deutsch, that legally, he did not have to put in any Medicaid beds, but morally he should.
