<br />read and believed that the Sunshine Law was set up so that residents of the community can <br />get information about the Council and their involvement should only be to provide them. <br /> <br />Ms. Carr stated that it did not belong in Council Rules. Mayor Welsch said she believed it <br />should be in Council Rules and should be in the area where the City Clerk’s job is discussed <br />as by State Statute the City Clerk has that job. <br /> <br />Mr. Kraft suggested that this could be incorporated in a Sunshine Ordinance. <br /> <br />Mayor Welsch noted that if it is clear in an ordinance then it would not need to be in their <br />rules as it affects Council’s actions. <br /> <br />Ms. Carr moved to delete Rule 32 as per Mr. Kraft’s suggestion. Rule 32 read <br />“Communications on behalf of the City or Council to the press or outside agencies and other <br />government, etc. shall be made by the Mayor or cleared with the Mayor in advance.” <br /> <br />Mr. Kraft stated that there were two ways to go about it. One would be to delete it. <br />Secondly, he said that any rule with etc. in it is by definition vague and limits a specific kind <br />of speech, political speech. He said he would not mind replacing the it with a little more <br />benign rule which would say the Mayor and City Manager will be the official spokes-persons <br />of the City, however nothing in this rule was to limit the speech of any member of Council. <br /> <br />Mr. Sharpe said there should be a single spokesperson for some incidents that occur within <br />the City. <br /> <br />Ms. Carr stated that if the spokesperson was speaking for the Council about policy, they <br />should only represent the policy and the will of the Council and thought the lines were <br />blurred. She did not like the idea that she needed to ask permission to speak. Ms. Carr <br />suggested it be case by case. <br /> <br />Mr. Sharpe stated that many times the press calls individual members and they should not <br />be answering unless they have all the facts and he said many times they do not. <br /> <br />Mayor Welsch said it would be difficult in an emergency if done case by case where the <br />whole Council would have to be brought together. <br /> <br />Ms. Carr asked if the upcoming study sessions be postponed because her constituents and <br />the constituents of Mr. Crow and Mr. Price have been disenfranchised by their lack of ability <br />to appoint to particular boards which is in rule 38. <br /> <br />Mayor Welsch noted there were a lot of study sessions already schedule but could schedule <br />an additional session for members who would want to come. <br /> <br />Mr. Crow did not like the lack of rotation in three commissions. <br /> <br />Study session was adjourned at 6:28 p.m. <br /> <br /> <br /> <br />Joyce Pumm, MRCC, MCC <br />City Clerk <br />5 <br /> <br /> <br />
