SESSION I697 <br /> <br />MINUTES OF THE UNIVERSITY CITY COUNCIL <br /> <br />MAY 19, 1997 <br /> <br />At a regular meeting of the City Council of University City held in the Council Chamber of City Hall on <br />Monday, May 19, 1997, Mayor Joseph L. Adams called the meeting to order at 7:30 p.m. In addition to <br />the Mayor, the following members of the Council were present: <br /> <br />Mr. Wayne I. Munkel <br />Mr. Robert G. Wagner <br />Mr. Lawrence Lieberman <br />Mr. Patti E. Schoomer <br />Mrs. Betty Thompson <br /> <br />ABSENT: Mr. Hardy Ware was excused. Also present was City Manager Frank Ollendorff. <br /> <br />MINUTES <br /> <br />Mr. Wagner moved approval of the May 5th regular meeting minutes. Mr. Schoomer seconded and all <br />voted aye. <br /> <br />Mr. Wagner moved approval of the May 5th special meeting minutes. Mr. Schoomer moved approval <br />and all voted aye. <br /> <br />RESOLUTION: TCI CABLE PARTNERS INCREASING RATES: <br /> <br />TCI Cable Partners has filed, with the City Clerk, an FCC Form 1240 to raise monthly cable rates from <br />$5.33 to $5.64 in compliance with the 1992 Consumer Protection and Competition Act which allows <br />cable service providers to make a reasonable profit while protecting consumers from over-priced cable <br />services rates. <br /> <br />Mr. Schoomer, reluctantly, moved approval. Mr. Wagner, reluctantly, seconded the motion. <br /> <br />Responding to Mrs. Thompson, Mr. Ollendorff replied that the Federal Government allows cable <br />companies to increase their rates and the City has no authority over those rates. The City Council has <br />authority to review the submitted Form 1240 to make sure that they have filled in all of the required <br />information. The form is complete and it meets all of the Federal requirements. The City has no choice <br />but to adopt the resolution. The City could fight it by incurring legal expense to file a case with the <br />Federal Communications Commission. Mr. Ollendorff continued by saying that the City would not <br />have a case and would expend unnecessary funds attempting to claim one. <br /> <br />Mrs. Thompson wanted to make sure that the City administration assures that TCI provides good <br />programming and service to the residents. <br /> <br />Mr. Lieberman said that he understands the Federal Government allowing cable service providers rate <br />increases, but he questioned, whether or not, there was a cap in place to control the increases. His <br />concern stems from the fact that TCI is increasing their rate by 5.8%, when the Consumer Price Index is <br />only approximately 3%. Mr. Ollendorff said that there were limits, but there was not a cap in terms of <br /> <br /> <br />
