Mr. <br />Lieberman inquired to whom the cable service providers have to justify the rate increases. Mr. <br />Ollendorff responded first to the City and then to the Federal Government. The City cannot approve or <br />disapprove the rate increase themselves, but can make sure all requirements have been met. <br /> <br />Mr. Lieberman further inquired of Mr. Ollendorff whether or not TCI has submitted material which <br />justifies a 5.8% increase. Mr. Ollendorff said that the Form 1240 shows in detail TCI's basis for coming <br />up with a .31 monthly increase and that the City has checked it against the Federal rules as best as they <br />cotfid be understood. <br /> <br />Mayor Adams further explained to Mr. Lieberman that he really believed and understood Congress' <br />concept of this regulation, however the Federal Communications Commission have a great deal of <br />latitude and authority and that the City had little to no choice in the matter. They have even gone as far <br />as to ignore other cities zoning laws. <br /> <br />Mr. Munkel asked Mr. Ollendorff what our legal costs would be were the City to oppose the rate <br />increase. Mr. Ollendorff said he did not know, possibly thousands of dollars. Mayor Adams said that it <br />would be astronomical and that the City could not win. <br /> <br />Mayor Adams queried the Council on whether to adopt this resolution. The motion carried <br />unanimously. <br /> <br />RESOLUTION - PARKING RESTRICTIONS RESCINDED - LOOP AREAS: <br /> <br />Mayor Adams said that this resolution directs the City Manager to work in conjunction with St. Louis <br />County to rescind parking restrictions in the Loop Special Business District and to temporarily rescind <br />parking restrictions at the north side of Delmar, from Eastgate to Westgate, during the parking garage <br />construction. <br /> <br />Mr. Schoomer, the sponsor of the resolution, said that this enables the City Manager to attempt to <br />implement a long standing element in the development of the commercial district. This was first <br />suggested in 1968 in a general plan which was approved by the Council, the Traffic Commission and <br />the County Department of Highways. The immediate reason for doing this is to temporarily relieve <br />parking problems resulting from construction traffic around the site of the parking garage. <br /> <br />Mr. Munkel moved approval of the resolution. Mr. Lieberman seconded the motion. <br /> <br />Mr. Wagner was concerned that the wording of the resolution implied that there was a connection <br />between parking on the south side of Delmar with the parking problems related to the construction of <br />the parking garage. He did not understand the logic behind linking these two issues together. Mr. <br />Wagner further stated that he had no problems with the Loop businesses wanting more parking for their <br />customers along the south side of Delmar. The problem during the 4 p.m. to 6 p.m. rush hour was <br />westbound not eastbound. Mr. Wagner pointed out that under section one of the resolution the <br />parking restrictions would be permanently rescinded. Whereas in section two, the parking restrictions <br />would be rescinded temporarily. He wanted to make it clear that the parking restrictions would be <br />reinstated once the parking garage was completed. With his concerns voiced, Mr. Wagner stated he <br />would support the resolution. <br /> <br /> <br />
