<br /> <br />Mr. Kraft asked for correction or explanation regarding eminent domain as he believed <br />eminent domain was totally a separate step. <br /> <br />City Attorney Mr. Martin agreed and stated the public hearing was about the blighting <br />analysis. <br /> <br />Mr. Price asked if the developers quoted a buyout for the tenant’s practice, does the <br />individual have the option to re-open the practice if the buyout was accepted and Mr. <br />Droney said no. Mr. Price asked if the new construction located behind the Walgreens <br />would have been 3,000 sq. ft. Mr. Droney stated the building would have been more <br />than 3,000 sq. ft. He asked if a space was built in the back would the person have the <br />option to be bought out as well and Mr. Droney said no. <br /> <br />Kent Evans, V.P. Intelica /Commercial Real Estate 15455 Conway Road, stated there <br />was not an unlimited supply of money and it was dwindling. He noted, in addition, <br />Walgreens has also been affected by the slow economy. Mr. Evans said that all these <br />things were compressing the available amount of funds, potentially compromising the <br />project by dragging it out. He said if the project did not happen, you are left with a <br />building that does not support itself and the City would end up condemning it anyway. <br /> <br />Mr. Crow stated that the City Council has always been in support of this project and at <br />some point needed to move forward. <br /> <br />Mr. Sharpe noted that he heard this presentation at the last Plan Commission meeting, <br />noting that they wanted to make sure the tenant was notified and asked her to be at this <br />meeting. Mr. Sharpe said he would like to hear from the tenant. <br /> <br />Mayor Welsch verified that the tenant was present. <br /> <br />Mr. Kraft questioned if eminent domain happened, it would be with the property owner. <br /> <br />City Attorney Mr. Martin said that was correct. The owner of the property would be the <br />defendant in the eminent domain but to take care of the lease you have to condemn the <br />property and then it is up to the tenant to make whatever case they can to the judge of <br />what the tenant would be entitled to regarding the eminent domain award. Mr. Martin <br />said this would all be done as part of the same proceeding. <br /> <br />Dr. Winsome Henry-Ward <br />Dr. Henry-Ward occupies the remaining leased space at 8390 Delmar Boulevard, Suite <br />1001. She stated she has been at this location since 2006. Dr. Henry-Ward stated her <br />objection to the blighting and said she could back up all her statements with written <br />emails detailing all communication with the project leaders and their legal counsel. Dr. <br />Henry-Ward stated she just wanted to be dealt with fairly. <br /> <br />Mr. Edward J. McCarthy, 7101 Princeton Avenue <br />Mr. McCarthy said that he did not believe it was a good policy to get involved with two <br />private parties but he would like this project to move along.
