<br />not in support of any Tax Increment Financing (TIF) involved, but did believe this was a <br />good project. <br /> <br />Mr. Gregory Pace, 7171 Westmoreland Dr. <br />Mr. Pace had a copy of the PGAV Report (33 pages) stating there are cosmetic issues, <br />but the building is not falling down, dangerous, or unsanitary. <br /> <br />Mr. Crow asked if the City was doing a Community Improvement District (CID) for the <br />traffic light, but no TIF. Ms. Riganti said that was correct. He asked Ms. Riganti to verify <br />if there had been proper communication and Ms. Riganti said there had been. She <br />noted the City staff has also offered to meet with the tenant to help facilitate this project <br />but was turned down. <br /> <br />Mr. Price asked if the total building was vacant except for one tenant, what would be the <br />landlord’s obligation to the building. He asked what the City does to maintain the <br />upkeep of that total space. <br /> <br />Mr. Martin stated that the City’s obligation for deteriorating building would be the same <br />regardless of whether it was this property, a home or any other business. He said the <br />City would be able to enforce the building codes to their fullest extent and the owner <br />would have to make a decision about if it would benefit them to keep it, let go of the <br />property, or be foreclosed on. If conditions deteriorated too greatly the City would come <br />in and condemn the property. <br /> <br />Mr. Price asked can the Landlord say he is closing his building with one tenant left and <br />do a buyout with the tenant. <br /> <br />Mr. Martin stated that the owner’s contractual obligations would survive until something <br />happened. If the entire building was vacant with only one lease, the owner still has <br />contractual obligations. <br /> <br />Mr. Kraft asked if this would be on the agenda at the next meeting in a form of an <br />ordinance. <br /> <br />Mr. Martin said it would be in the form of a resolution permitted under the Land <br />Clearance Redevelopment Authority Law. <br /> <br />Mr. Sharpe said the tenant stated she was not dealt with fairly and requested to see <br />pictures because the Council does not want this tenant to be dealt with unfairly. <br /> <br />Mr. Martin stated the tenant said she would be willing to submit email streams <br />substantiating what she claims to be the case and was sure the developer could do the <br />same. <br /> <br />Mr. Sharpe stated he just wants to make sure the space given to the tenant was suitable <br />and asked to have a meeting with the tenant prior to the next Council meeting. <br /> <br />Mr. Price wanted to make sure all information was factual and the tenant was dealt with <br />fairly, but did not want project to be held hostage if everything was above board. <br />5 <br /> <br /> <br />
